In a press release on July 10th, 2009, Homeland Security Secretary Janet Napolitano announced that the U.S. Immigration and Customs Enforcement (ICE) has standardized the Memorandum of Agreement (MOA) used to enter into ‘287(g)’ partnerships. Section 287(g) was originally added to the Illegal Immigration Reform and Immigrant Responsibility Act (IIRAIRA) of 1996, ostensibly to empower local law enforcement jurisdictions to aid in the apprehension of illegal aliens.
However, Napolitano’s new MOA indicates that in fact, she believes the 287(g) has not been employed in the spirit of its original intent in certain jurisdictions. She goes on to explain, “This new agreement supports local efforts to protect public safety by giving law enforcement the tools to identify and remove dangerous criminal aliens.”
The press release continues; “To address concerns that individuals may be arrested for minor offenses as a guise to initiate removal proceedings, the new agreement explains that participating local law enforcement agencies are required to pursue all criminal charges that originally caused the offender to be taken into custody.”
Are you getting this? From the standpoint of the Department of Homeland Security, entering the country illegally in and of itself is not a sufficient crime to justify arrest and prosecution. Apparently there is a threshold for acceptable and unacceptable illegal aliens. “Serious criminal” illegals will not be tolerated, but law abiding illegal aliens (try figuring that one out) are welcome to stay.
Many believe this policy change was initiated primarily because of Maricopa County Sheriff Joe Arpaio who has been at the forefront of using the 287(g) agreement. In fact, illegal alien rights groups and pandering politicians were quick to seize the opportunity to praise Napolitano and criticize Arpaio.
Unionvoice.org, a labor organization, issued this statement on their website; “In recent months, the hard work of many has raised the profile of Sheriff Joe Arpaio, the most infamous Sheriff since Bull Connor, as the ugliest face of the failed national 287(g) program. The Sheriff's march of migrant inmates in a chain gang the New York Times described as ‘ritual humiliation’ revealed the racial profiling and terror he's carried out on Maricopa County, and made urgent the need for federal intervention.”
Even Phoenix Mayor Phil Gordon, always looking for potential votes, was quick to react in his criticism of Arpaio in a myfoxnews.com story. “Let me be blunt, this confirms that Homeland Security has taken the concerns about Sheriff Joe Arpaio’s abuses and misallocation of resources seriously. He can no longer hide behind the illusion that breaking up families at car washes and amusement parks is somehow making us safer as a community."
That statement is fairly remarkable considering Arizona’s current 2.6 billion dollar budget deficit. Perhaps the $1 billion paid annually to illegal aliens in services for schools, medical care, welfare anchor babies and prisons is of no consequence to Mayor Gordon, but Arizona families facing tax increases and dstruggling under the weight of a devastated economy and declining home values might feel very differently.
For his part, Arpaio remains steadfast and defiant. In a Wall Street journal story, he said “If I’m told not to enforce immigration law except if the alien is a violent criminal, my answer to that is we are still going to do the same thing, 287g or not.”
As always, Arpaio continues to do exactly what he was elected to do; simply enforce the law.

My hope is that the programs Obama/Napalitano have put forward to protect the communities and jobs of American citizens are enforced to the letter of the law. If the jobs and free public services for illegal immigrants dry up, it will create "deportation by attrition".
Probably the best of all possibilities. This will significantly decrease the numbers of illegal immigrants in the local communities and allow the work place systems (E-Verify) to deal with the rest in a reasonable way.
The people left will need to either become a part of this country and abide by the laws, or lose their jobs, food stamps and welfare checks.
In the meantime, the illegal immigrant criminals will be dealt with more harshly. Tried, Convicted, fingerprinted and photographed with all data entered into the federal system. This way if they show up again, we'll know who they are and punishments will escalate with every additional infraction. That's fair.
Not even the ACLU can object
Seems like Arpaio's legacy will live on through whatever off-kilter followers his actions spawn. Been writing plenty about it on Long Island Wins.
Sheriff Joe Arpaio sticks to the basics. His job is simply to enforce the laws. All laws. He is very successful. I wish more sheriffs would follow. We live in an age, during a war, where we need for our elected government to get us on a "war footing" and put the BS aside. Governors can call a draft, or suspend laws that impede our defensive ability. We need to awaken the militia in our towns, and prepare for defensive operations. Our women need to make bandages, and prepare for many wounded. Build the pantry we will need to feed our community if we are isolated by disease or war. Be ready. Talk to your city council.
FYI: Immigrating to the U.S. illegally is not a CRIME, and opponents of illegal immigration should be happy with that! If it were a crime, the Bill of Rights would guarantee every illegal immigrant a jury trial. There is no "prosecution" for illegal immigration-- just an administrative hearing followed by removal.

Crimes and juries:You are WRONG! Entering the country is a crime,but you have to catch them in the act of crossing the border. If you have been deported previouly,it is a felony whether caught at the border or in the interior:TITLE 8 section 1325 US code. Lookup operation STREAMLINE and Del Rio sector there is 100% prosecution for illegal entry or presence.
Napolitano needs to be removed from office, like, yesterday! She's the Enemy of the People. Since her first day in office, she's been trying to UNDERMINE enforcement of our Fed. Immigration Laws, and NOW she's trying to DESTROY the highly successful 287(g) program!
I have read hundreds,(at least), posts in which Janet Napolitano was called a traitor, going not so far back to her Governor days in Arizona. Truth be told, I can't think of a better name for her as well as the whole Democratic agenda. Anything to actually prevent illegal immigration and the many burdens it puts on America's citizens.
Carlos is correct. I looked up the law and Crimes and Juries has been exposed as a LIAR, no doubt with an agenda.
Now I know why all those Anchor Babies in baby carriages show up on Chicago Transit Authority buses and block American handicapped citizens in wheelchairs from getting onboard.

I think that there is one major point that seems to elude every conservative; you will always appear to be simply racists, as long as you continue happily ignoring the businesses that hire these illegal immigrants, instead trying to fight a a battle any child can see is a losing one.
Hmm, go after millions of individual illegals, who will keep on coming since the jobs for them are still there, or go after the thousands of companies that give them work here in the first place? Conservatives will always choose the former, showing their true colors, and thus will never get it.
