Interview with Judge Don Lowery
Q: "In what cases should abortion be legal?"
A: "Incest, rape or when the life of the mother is threatened."
Q: "Is it feasible and humane to build a border fence, have the police detain illegal immigrants when they encounter them and take them to deportation facilities?"
A: "Yes. Economically, I don't know what it would cost to secure our border, but absolutely, we must secure our borders. We must do whatever it takes...It is a matter of national security."
Q: "You may end up voting on Supreme Court nominees. Explain judicial activism, what it means to be a 'strict constructionist' and whether or not you believe the Constitution is a 'living document.'"
A: "Judicial activism is where a judge gets on the bench and decides that they have the power...and they'll move a social agenda forward or anything else that is of their particular interest. That is unacceptable...The Constitution is the granite cornerstone of our society...and it shouldn't be modified."
Q: "Does Article 2, Section 2 of the Constitution make the un-examined appointment of czars illegal?"
A: "I don't think that the appointment of czars is legal at all because they are policy-making people that I believe come under the same rules and regulations as cabinet members and I think they are subject to Senate confirmation."
Q: "How do you prevent groups like ACORN from getting federal funds?"
A: "We have to have sunset clauses on appropriation bills. We have to have single-subject legislation that doesn't allow for the hiding of earmarks."
Q: "Have you signed the Manhattan Declaration?"
A: "I believe I have already signed it. I've been to that site several times. If I haven't, I will."
Q: "Is global warming happening, man-made and/or a threat to take seriously?"
A: "We have climate change, but I think it's cyclical. I think that man may have a minimal effect on that, but...I'm not sure that it causes a global warming or cooling."
Q: "Should we have allowed General Motors to go under?"
A: "Yes, we should have. They should have never been given the $30 billion first that George Bush gave them, and then the bailout. We live in a free market economy. And when the government gets involved, they never get out of it."
Q: "Has the stimulus package slowed the recession?"
A: "I don't think so. I don't think it's helped at all. That stimulus package was passed in January. In that were 9,000 earmarks. Currently, they're saying that about 16-18% of that has been spent. However...85% of that was on the 9,000 earmarks, which had no resemblance to any kind of stimulus."
