Terry Nichols
Terry Nichols was convicted, along with Timothy McVeigh, of the Oklahoma City bombing in 1995; he is currently serving a life sentence at the Supermax prison in Florence, Colorado. There, alas, his daily fiber needs are not being met, which Nichols claims is a violation of his Eighth Amendment rights protecting him from "cruel and unusual punishment." Nichols requested a court-appointed attorney to sue the prison on his behalf.
Yesterday, U.S. Magistrate Judge Craig B. Shaffer of the District of Colorado ruled that Nichols did not have the right to a court-appointed attorney for his civil suit. Poor Terry Nichols will have to continue representing himself if he chooses to proceed with the lawsuit.
A copy of Nichols’s pro se Complaint can be found on the Smoking Gun website. Among his allegations, Nichols complains:
Plaintiff is compelled to consume daily those unhealthy dead and refined foods that are abhorrent to Plaintiff’s sincerely held religious beliefs, causing him physical, mental and spiritual torment, and to sin against God.
The 100% whole grains and insoluble fiber, Nichols notes, are necessary for the medical health of his body “i.e., God’s holy temple.” To support his cause, Nichols includes a declaration of Eric Rudolph, bomber of multiple abortion clinics as well as the 1996 Atlanta Olympics, who confirms the inadequacy of the refined food served at the prison. Perhaps these men would be taken seriously if they had given any thought to the “holy temples” of their victims.
