Federal lawsuit filed against Homeland Security Secretary Napolitano

 (The following information was delivered to the National Association of Chiefs of Police by the Thomas More Law Center.)

The Thomas More Law Center, a national public interest law firm based in Ann Arbor, Michigan, announced Friday evening that it filed a federal lawsuit against Homeland Security Secretary Janet Napolitano. 
 
The lawsuit claims that her Department's "Right-wing Extremism Policy," as reflected in the recently publicized Intelligence Assessment, "Right-wing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment," violates the civil liberties of combat veterans as well as American citizens by targeting them for disfavored treatment on account of their political beliefs. 
 
According to the Law Center, Napolitano tried to blunt the public furor over the Report by a half-hearted apology to veterans, but she left out of her apology all of the other Americans her Department has targeted because of their political beliefs.
 
According to the lawsuit, officials at the Department of Homeland Security admitted that their internal office of civil liberties objected to the language in the "extremism" report, but the Department issued it anyway.

Richard Thompson, President and Chief Counsel of the Law Center stated, "Janet Napolitano is lying to the American people when she says the Report is not based on ideology or political beliefs. In fact, her report would have the admiration of the Gestapo and any current or past dictator in the way it targets political opponents.  This incompetently written intelligence assessment, which directs law enforcement officials across the country to target and report on American citizens who have the political beliefs mentioned in the report, will be used as a tool to stifle political opposition and opinions.  It will give a pretext for opponents of those Americans to report them to police as right-wing extremists and terrorists.  You can imagine what happens then."

The Report specifically mentions the following political beliefs that law enforcement should use to determine whether someone is a "right-wing extremist":

* Opposes restrictions on firearms
 
* Opposes lax immigration
 
* Opposes the policies of President Obama regarding immigration, citizenship, and the expansion of social programs
 
* Opposes continuation of free trade agreements
 
* Opposes same-sex marriage
 
* Has paranoia of foreign regimes
 
* Fear of Communist regimes
 
* Opposes one world government
 
* Bemoans the decline of US stature in the world.
 
* Upset with loss of US manufacturing jobs to China and India  

The lawsuit was filed in the U.S. District Court for the Eastern District of Michigan on behalf of nationally syndicated conservative radio talk show host, Michael Savage, Gregg Cunningham (President of the pro-life organization Center for Bio-Ethical Reform, Inc (CBR)), and Iraqi War Marine veteran Kevin Murray.  The Law Center claims that Napolitano's Department (DHS) has violated the First and Fifth Amendment Constitutional rights of these three plaintiffs by attempting to chill their free speech, expressive association, and equal protection rights.  The lawsuit further claims that the Department of Homeland Security encourages law enforcement officers throughout the nation to target and report citizens to federal officials as suspicious rightwing extremists and potential terrorists because of their political beliefs. 

Thompson added, "The Obama Administration has declared war on American patriots and our Constitution.  The Report even admits that the Department has no specific information on any plans of violence by so-called ‘rightwing extremists.'  Rather, what they do have is the expression of political opinions by certain individuals and organizations that oppose the Obama administration's policies, and this expression is protected speech under the First Amendment." 

The Law Center is asking the court to declare that the DHS policy violates the First and Fifth Amendments, to permanently enjoin the Policy and its application to the plaintiffs' speech and other activities, and to award the plaintiffs their reasonable attorney's fees and costs for having to bring the lawsuit.

    Where is the ACLU
    Do they not protect all rights or do they only pick and choose what they want to protect.

    President Obama had the opportunity to select a qualified national security professional from within the ranks of those who happen to register as Democrat. Instead, he chose an imcompetent scumbag polarizing small state bumbling idiot. Perhaps this lawsuit will shed light on the mindset of Obama's handlers. Obama is merely he sock puppet who appoints who he is told to appoint all in the grand tradition of Chicago politics.
    We are very close to repeating the visions of another charismatic leader from the 30's in Germany. I pray for our country and hope we can remain intact until the 2010 elections. Ohio can ill afford to elect anyone who blindly supports Obama and his Himmler like troll.

    The Thomas More Law people should take their medicine more regularly. Then they could be more relaxed. Napolitano was too mild and optimistic with the "Right wing" report. The reaction to the report, by itself, shows how correct it was.

    No matter what political ideologies a group has, if they are planning violet acts and recruiting people to purposefully destroy the country I think it is wise for Homeland Security to keep an eye on them. Stop jumping on the bandwagon here people, it is a real intelligence report based on real threats, yes, by right wing extremist groups, not targeting all right wing citizens.

    Back on 14 April, I submitted a Freedom Of Information Act request to Homeland Security. My FOIA is directed specifically to Quinton Mason, Catherine M. Papoi and Vania T. Lockett, all with Homeland Security.

    With my being a red skinned girl, I am highly interested in this reasoning for including American Indians in this right wing extremist warning. My FOIA directly addresses this issue.

    White boys are typically not a problem on our tribal lands; they stand out like a sore thumb. Highly unlikely any of my peoples will be joining the Ku Klux Klan nor the Aryan Nation anytime soon.

    I am quite certain I am now on the Homeland Security watch list and on the FBI watch list; an individual submitting an FOIA request is sufficient cause for law enforcement suspicion, especially when a red skinned middle aged conservative soccer mom.

    This right wing extremist report issued by DHS and Barack Obama reminds me of Richard Nixon, his enemies list and using the IRS to punish his political enemies.

    I have no doubt Obama either received an advance copy of this DHS report or, at least, was briefed about this report, in advance. Obama remaining silent on this issue suggests to me Obama is giving his tactic approval for making political targets of Americans who are of a conservative political leaning.

    Richard Nixon used his enemies list and the IRS to suppress his political enemies.

    Obama is using his conservatives list and the DHS to suppress his political enemies.

    Nixon right or Obama left, actions of both violate our Democratic way of life. This type of traitorous behavior cannot be tolerated.

    I suppose one of the watch dogs of Obama is reading this blog and I will be reported to law enforcement for my seditious commentary.

    Those brain police will be challenged to set foot on our tribal lands to take me away; they may find themselves scalped and tossed.

Cuba or Venezuela would take you in. Enjoy your food ration card and the bits and pieces you'll find of garbage for sale in the groceries... if any.

    Janet Napolitano has Marched in Gay Rallys, well hell guess this makes her an extremist, what happens if gay marriage is not passed is she going to go nuts. As a U.S. Soldiers Mom, I find her to be very ignorant and if I had the money to sue her I would do it myself.     I saw this report some time ago, and downloaded a pdf copy, It is not just what is proposed by the report, which dis-enfranchised Americans, and specific classes of Americans, But consider all the violations of the 4th and 8th and 14th amendments that will occur. I have been to countries that existed pre-Berlin wall fallout, and our country is coming very close to this police state regime. I applaud this group for bringing this action. I proprose that they make it a class action.
