Many companies now require a background check and some even go as far as checking your credit history to make hiring decisions. With identity theft on the rise, citizens just give away their information willingly to these companies in hopes of gaining employment. Many Americans and law makers fail to understand that what these companies are doing violates your Fifth Amendment right to privacy. In other words it’s unconstitutional and therefore illegal. So how do they get away with it?

Some law makers have said that since there are no laws against it companies can run credit checks on people pointing to company evidence that people with bad credit somehow don’t perform well at work. Are you kidding me? That may have been true in the old days when it was nearly impossible to have bad credit but now a days you have many factors that play into credit like divorce, child support, alimony, doctors and hospitals mixing up codes that insurance won’t pay for. Recently people have fallen behind because of the recession and job loss. These things do not make people strive any less in the work place.

There is evidence that courts have falsified charges on individual files. You may have a record and not even know it. One individual decided to look on line at his background and found he had a trespassing charge but he had never been in trouble with the law before. When he called the court where the charge was filed he was told he would have to get an attorney to have it expunged. When he explained he couldn’t afford an attorney and had never committed the crime, the court pretty much told him “oh well.”

Hospital billing departments are famous for mixing up your billing codes. Some may even lie and say even though your insurance pays one hundred percent there are still charges. If your insurance pays one hundred percent how could there still be charges? There can’t be. It means the billing code was wrong and your insurance did not cover it because of that. When you try to dispute it with the credit bureau, the credit bureau will always side with the business who reports it, whether it’s their mistake or not.

There is a lot of hanky panky going on in business these days when it comes to consumers and law makers have ignored it. Some lawmakers like Rep. Carolyn McCarthy from NY would like to see it go a step further. She introduced the No fly, No buy legislation on May 13th of this year with 3 cosponsors, Eleanor Norton D DC, Steve Israel D NY, and Carolyn Maloney D NY. The legislation would amend the Brady Hand Gun Violence Prevention Act according to Govtrack.us to prohibit: (1) the sale or other disposition of a firearm or ammunition to any person knowing or having reasonable cause to believe that such person is an individual required to be prevented from boarding an aircraft; and (2) the shipment, transport, possession, or receipt of a firearm or ammunition by such individuals.

This could be you and you wouldn’t even know it. Someone can falsely accuse you anytime. I would strongly suggest everyone get a personal background check because our lawmakers have enabled these entities to get away with it.

    Well Bob it's very simple you see, 2+2=4. Once you know the answer to that equation, or more to the point how the equation works, then you can figure out how I got there. Good luck Bob!
