In reaction to the temporary stay Judge Vaughn Walker placed on his ruling overturning Prop 8 last week, CA Attorney General and 2011 Governor hopeful Jerry Brown, along with current CA Gov. Schwarzenegger, each separately requested the judge to release the stay and resume issuing CA marriage licenses for gays in the state.
Attorney Kenneth C. Mennemeier representing Governor Schwarzenegger wrote, "The Administration believes the public interest is best served by permitting the Court's judgment to go into effect, thereby restoring the right of same-sex couples to marry in California."
Previous to the Governor's submission, CA Attorney General and 2011 Democratic Governor hopeful Jerry Brown (and former CA Governor from 1975-1983) filed a motion against Walker's stay, demanding the reinstallation of gay marriage rights in the Golden State.
Brown explained, "... while there is still the potential for limited administrative burdens should future marriages of same-sex couples be later declared invalid, these potential burdens are outweighed by this court’s conclusion, based on the overwhelming evidence, that Proposition 8 is unconstitutional."
Walker is expected to decide on whether to eliminate or lengthen the stay sometime over the following days.
