Did Jon Gosselin commit fraud?

In regards to the $230,000 Jon Gosselin supposedly removed from his and Kate Gosselin's joint bank account, one of Kate's cabal of attorneys, Martin Singer, said in a scathing letter to Jon's divorce lawyer Mark J. Heller that Jon's actions "may also give rise to substantial claims for fraud."
The letter (PDF), acquired by gossip website TMZ, also accused Heller of being complicit in the withdrawal of the funds, perhaps to use that money to pay Heller's fee. Why would he think that? Because apparently the Supreme Court of New York found that Heller took such action with a previous client, instructing them to "withdraw everything that's in the bank." Singer says at the very least he believes Heller was fully aware of what Jon had done.
Singer also calls Jon's alleged actions "outrageous conduct," and he is demanding "the immediate return of all the monies to the account."
Speaking of the account, it's described in the letter as a "Money Market Account." Is that the type of account one normally has to pay day-to-day bills, as Kate claims she no longer can do? Admittedly we don't have the fame and fortune of Jon and Kate Gosselin so perhaps we're ignorant on such matters.
Kate's attorneys are expected to show up in court looking to get Jon charged with contempt of court. The drama continues...

Generally, a money market account is not used to pay day-to-day bills. It's an interest-bearing checking account, but withdrawals are usually limited to a certain number per month before you start getting charged per every check written.
Thanks for the explanation, spooky926. And now I'm even more confused how that account being emptied would leave Kate destitute and not able to drop a bunch of checks into the mail, according to her, since one wouldn't normally be writing a lot of checks from that type of account... what a mess.
because Kate Gosselin is a liar! Nothing that comes out of that woman's mouth is true. she's so full of herself.
Kate said she found out about Jon's theft when she called to have money transferred from the money market account to the checking account.
People with this much money coming in & going out use money market accounts that pay higher interest rates. You only have to $100 to open one but there can be monthly & yearly maintance costs that can only be offset by keeping a higher balance.
The arbitrator for the divorce set the rules for the account. Neither party were suppose to withdraw large amounts. The account was to pay for the house expenses such as property tax, etc. set forth by the arbitrator. Kate did not ask for child support. The money she made on approved speaking engagements went into the family account. Thus, when the divorce was final, Jon would not longer get a cut from successful Kate, thus, his reasoning for halting the divorce. At the same time, he was being removed from the show because of his behaviour, he could not longer live off Kate & the kids. If it had not been for Kate the family would be on public assistance. Jon didn't work at the time of the birth of the 6, he was fired from his IT job, and jealous that he wasn't successful at speaking as Kate. He is mentally challenged and doesn't care if he hurts his children.
"OK read the details" -- read the details where? Where did you see that? The original reports I saw were that Kate discovered it when she received notices of overdraft checks and she called the bank to inquire. At this point I think both of them are playing games here and the public are their pawns, to be quite honest.
Also, keep in mind that Kate admitted she also removed a large sum of money from that account in violation of the agreement, the only difference is that she put it back.

I think Jon just may have finally done himself in.
Jon is a money hungry, jelous, jerk who has a long way to go to maturity. This is happening because TLC wont let Jon out of his contract to film 'divorced dad's'. So he has left his family without an income. WAY TO GO, JON! Shows what your appology is worth and how you act as 'a man'!

An independent CPA should audit all accounts and the truth should be made known. Maybe a third party should be in control of all money. Both parties should have to undergo psychological tests done to see if they are compentent to raise 8 kids.
I have a MMA that is like a check-book. One just needs to keep a minimum balance. I have some bills automatically paid from it. I think the real issue is why did Jon withdraw so much money in about 6 weeks according to what the attorney for Kat submitted to the court? Did he spend the money, give it to his new crooked attorney, or blow it on dope?
Spooky926 is incorrect about money market accounts. I can have as many tranfers, withdrawals, and can write as many checks in 1 day as I want as long as I don't go under the required $10,000 balance, if I do go under the required balance service charges are incurred on each transaction. You have to set up your MM accounts in accordance with the bank policy and policy for each bank is different.
The biggest frauds in this mess are Jon and Kate themselves. They are both presenting themselves as parents who put their kids first.Apparently the kids are acting out and being rowdy. Gee,do you think that just might be an attempt to get some attention from their feuding parents?Now the trickle down effect from this nasty divorce is begining to surface.Apparently the nannies do 90% of the parenting.Kate hardly spends any time with the kids,and everything upsets her.Jon can't be around them for long, either.He especially gets upset when the kids interrupt him when he is talking on his cell phone,which seems to be all the time.He even took time from Cara and Mady's birthday party to walk down to the gate to chat with the papparzzi..talking on his cell phone, f course.He probably couldn't wait to get away from the kids,after making such a stink about his 2 hr. "time limit." The courts should freeze all the assets and appoint someone to oversee the spending until the divorce is finalized!
Jon should have doen a background check on this new slick Willy of a lawyer.He has taken his former clients to the cleaners. He probably advised Jon to empty the bank account,with plans on having that money end up in HIS bank account!Poor Jon is so stupid.He will end up penniless when the dust all settles. Jon and Kate are so greedy.They are both being sneaky and lying when it comes to the money. Kate has plenty socked away; she is no dummy.Unfortunately, the ones who will end up with the least will be those 8 kids.And the financial well-being and future of those kids were why Jon and Kate claimed they started doing the show in the first place.They certainly have lost their way, haven't they?The things people won't do for money.Jon complains that he has a $22,000 unpaid therapy bill?That's nothing compared to what it will cost to straighten those 8children out. Talk about needing therapy!The kids are already acting out in response to this nasty divorce battle,and J&K can't even see it
