Open letter to: Supreme Court Justice Sotomayor.

Dear Justice Sotomayor,

May I humbly pose a question?

Can a Supreme Court Justice be impeached?

The simple answer is ‘YES’.

Article III, Section 1 states that judges of Article III courts shall hold their offices "during good behavior." "The phrase "good behavior" has been interpreted by the courts to equate to the same level of seriousness 'high crimes and misdemeanors" encompasses.

How does this apply to you?

Well, let’s look at your Senate Confirmation Hearings.

During your confirmation hearings in front of the Senate Judiciary Committee, you repeatedly confirmed that Heller was "settled law." The AP reported that Sen. Udall, (D-CO), "said you told him during a private meeting that you considered the 2008 ruling that struck down a Washington, D.C., handgun ban as settled law that would guide you in your decisions in future cases."

Yet, when it came time to decide whether the 14th Amendment makes the 2nd Amendment enforceable against state and local governments, you refused to tell the senators how you might vote. So in voting against incorporation of the 2nd Amendment, you can claim you did not lie to the Senate. However, your actions in the McDonald case indicate that you really do not believe what you told the Senate.

 

So, you lied.

In your Senate testimony, you said, "I understand the individual right fully that the Supreme Court recognized in Heller," and, "I understand how important the right to bear arms is to many, many Americans." Yet your opinion in the McDonald case shows that what you really "understand" is that the Constitution does not really mean what it says.

So you tell me Justice Sotomayor, is lying to the Senate Judiciary Committee, during your confirmation hearings grounds for your impeachment?

Again, may I humbly make an observation.

In your dissent in McDonald,  you just jumped on the coat tails of the other three disenters. You failed to put pen to paper and tell us mere peons the reasons for your dissent. Could it be, that if you did so, you would admit in print your lying in your Confirmation Hearings.

Coming from a Supreme Court Justice, your position is pathetic, absolutely pathetic. And, it may be impeachable.

    In today’s world, I do not think the Justices are any different than any other politician, they will say what they know the other side wants to hear to secure the sought after position.
    I think that to become a Supreme Court Justice the First Requirement is a solid background in the US Constitution, and law from the Bench not the Front of it but behind it, As to the Dog and Pony Show of the Confirmation hearings, they should not be as they are now, to much theater, to little substance, all answers are for the most part rehearsed, and canned, so they serve no real value, as to the Potential Justice, The President has the right to appoint who he wants but there should be a set of requirements, that must be met first.

    A Surpeme Court Justice is supposed to put aside all personal feelings/poinions when deciding whether or not a law violates the Constitution or the Bill of Rights. Or whether a person's rights have been violated under those same documents. Obviously Sotomeyer has not done that or she would have expressed an opinion grounded in solid law based on those documents. The Federal Constitution/Bill of Rights should be incorporated into all state's law as a foundation for equal justice in every state. Beyond that all other rights are reserved for the states. Our Federal Supreme Court is becoming a mockery of justice as it is filled with unqualified people who are not legal but political experts. Kegan should be rejected simply because she has spent no time on the bench, has not ruled in cases, is a political appointee to all of her legal jobs in the past. Obama is filling the court with political hacks who have no experience and our lives depend on these frauds to the most prestigious job.

    How many Supreme Court justices have ever been impeached?

    I don't know, that's why I'm asking.

    I'd like to see all 4 of the dissenters in McDonald impeached for "bad behavior" as the verbiage of their dissent itself PROVES BEYOND ANY DOUBT that they are NOT fulfilling their Constitutional duty to uphold the Constitution and BoRs as the "Supreme law of the land." Read the dissent. There's absolutely zero historical basis. Their dissent is based solely on their personal dislike of firearms and their unwillingness to allow Americans to exercise their fundamental, God-given right to self-defense.

    There'll definitely not be an impeachment with the current Congress as the majority their are just as corrupt and disgusting as the four dissenting justices.

    Kelly: the "requirements" you seek, while laudable, would require nothing less than a Constitutional Convention to effect and that would be a DOUBLE-SIDED SWORD. So, step carefully.

    And, YES Sotomayor lied. Just as Kagan is lying. Remember, marxist philosophy calls for any means that justifies the end.

    Get on the court no matter how much you have to lie or omit telling the people so you can be in a better position to dismantle the Constitution and the people's individual liberties.

    Don't break your heart over Sotomayor. If you can live with Citizens United, you can live with her. I do not believe in "gun rights" and you have to accept that, too. Strap on and go enjoy Arizona night life with the other gun-toting drunks--they need your patronage because so many of us won't be there spending our money.
