Oklahoma bill will extend "Make My Day Law" to businesses

The State of Oklahoma has one of the strongest gun rights laws in their “Make My Day law. It may grow even stronger, if state senator Joe Sweeden of Pawhuska has his way. 

 
Senator Sweeden penned SB 2257 this year to enhance business owners rights in protecting themselves and their property. He was prompted to write the law by the robbery incident involving Oklahoma City pharmacist Jerome Ersland. Ersland currently faces first degree murder charges for shooting a 16 year-old robbery suspect in his place of business. Following is video of that robbery and the pharmacist retrieving firearms and fighting back:

 

 

 

 



Oklahoma’s “Make My Day” law originated in the 1980’s and is one of the strongest in the country. In fact, Arkansas lacks one of the key components of this bill; liability protection for citizens legally protecting their home, vehicle and life:

 
 
 
 
 
 

The court shall award reasonable attorney fees, court costs, compensation for loss of income, and all expenses incurred by the defendant in defense of any civil action brought by a plaintiff if the court finds that the defendant is immune from prosecution…

 
 
 
Representative Gus Blackwell of Goodwell is sponsoring the bill in the House. He believes this bill will clarify what a business owner’s rights are when being robbed or attacked.

    "Make My Day" Law? Oh, please - is there not a single "journalist" who can resist using every hackneyed cliche dreamed up by the Brady Bunch and their ilk? (Ever notice that any article about carry permit holders invariably denigrates them as "packing heat" instead of simply saying "carrying handguns" for protection.)

    A real reporter might have properly called the bill a "Robbers Beware" Law - which is essentially what it is. Normal Americans understand that any robber (whether armed or not) should know they assume a huge risk when they attempt to commit a crime, especially when it involves a physical confrontation.

    What next - letting the thugs mother file a "wrongful death" lawsuit against business owners who protect their property? Oh, wait, they already do that!
