In fewer than two years he went from being a cop and a popular CIty Council Member to being elected to the State Senate, now he's been convicted of a crime and today State Senator Hiram Monserrate lost his job... 

The New York State Senate voted Tuesday night to immediately expel a senator convicted of misdemeanor assault.

The 53 - 8 vote came following Hiram Monserrate's misdemeanor conviction for dragging his girlfriend, Karla Giraldo through his apartment lobby.  .

The Senate Democratic Conference, after meeting behind closed doors for more than five hours, agreed to put forth two resolutions Tuesday evening, one for Monserrate's immediate expulsion, another to expel him by June 30 or following his criminal appeal.

Democrats declined to consider a motion to simply censure him, which would leave him in office.

The National Organization for Women called tonight's vote, "ethically right."

Monserrate has said he's not leaving but declined further comment Tuesday evening followed by a pack of reporters.

The Queens Democrat has hired prominent civil liberties attorney Norman Siegel, who maintains that since Monserrate was popularly elected, only the voters can remove him from office.
