Should Pacquiao drop the lawsuit if the fight can still be made?

Manny Pacquiao and his legal team are currently filing papers in order to sue Floyd Mayweather Jr, his father, uncle and Golden Boy promotions for defamation.

The suit comes after Mayweather and his team demanded extra testing for Pacquiao and implied and outright said to varying degrees that the Filipino champion was taking performance enhancing drugs of some kind.

It isn't clear exactly what is going on just yet between Mayweather and Pacquiao, or who either fighter are facing next. Some sources say that various fights are already as good as made, while others are saying that there are still terms laid out by Top Rank which have a deadline of Monday for Mayweather and Golden Boy to agree to.

One aspect of this is whether Manny will continue to pursue his lawsuit of the fight goes ahead. Also perhaps more pertinent would be whether Mayweather will agree to any terms from Pacquiao now that a law suit is involved. Obviously there is blame within both camps as to why the terms could not be worked out peaceably, but if the threat of a lawsuit actually helps make the fight happen then so be it.

Otherwise the law suit seems like a fruitless endeavor from Pacquiao. While he may well win and make several million dollars, the lawsuit isn't going to stop people speculating about what he may or may not have taken. For the time and effort involved he might as well concentrate on training and make more with his next fight than spending time and money this way. Not to mention there are still figures from within boxing such as Paulie Malignaggi and Kermit Cintron who are not involved with the law suit and perhaps should be if his other accusers are.

Apart from anything else, Pacquiao realistically doesn't have a very good chance of winning the case. Mayweather and co undoubtedly slandered him, but defamation cases never tend to work out like athletes want them to, just ask Shane Mosley. Not only this but they can drag on for years and cost millions for both sides.

Surely the last thing Pacquiao wants is to have the drug allegations bandied about on a regular occurrence, even if only as part of the trial proceedings. Casual fans who don't know much about boxing or Manny Pacquiao and his good character might still come to think of Manny as 'that boxer from the drug testing trial' even if he wins.

For most of the people accusing Pacquiao and member of the public who now doubt his credibility, filing a lawsuit isn't going to change many opinions. Undoubtedly the testing episode damaged Manny's reputation, but being willing to sue over the issue doesn't really solve it either way. Manny still refuses to take the extra tests and those who doubt him will still doubt. A few million dollars isn't that much of a penalty for someone who can make that in a single night's work either. Roger and Floyd Sr. might be harder hit by substantial damages, but for Floyd Jr. this lawsuit will be ineffective whatever the eventual turnout.

The legality of offering to drop his lawsuit if the fight terms are made is something I'm not so sure on, but it sounds like something that would have to be offered under the table and away from the prying eyes of journalists and the public. Still whether or not there is any legal issue over this idea, it might prove effective should the fight happen.

After all, making $40 million dollars and getting his arch rival into the ring finally will be much more rewarding for Pacquiao than making perhaps one or two million for a defamation suit.

I don't think Manny has anything to hide, but suits like this tend to have a way of blowing up in the faces of all involved and being a waste of time and money. Lets hope the fight is made over the next few days and that the suit is forgotten about. Manny will be a lot better off doing his talking in the ring instead of the court room.

    Manny is the Fighter of the Decade, because he really fights. The best revenge that Manny can get against Mayweather is his pocket book. Manny should not be emotional on this issue, he should be Machevellian. Mayweather has no options, Pacman has several, JMM 3, Edwin Valero, Timothy Bradley, winner of Berto-Mosely and hence could easily make up the $40 Million he would have gotten Mayweather. Revenge is a desert best served Cold. Don't allow Mayweather to make a dime off of your name. Move on, Marginalize Mayweather and his career will wither and die. And we can all laugh that he came back to fight a bloated chubby Marquez and Matthew Hatton who lost to both Alan Bosworth and David Kirk, Combined loss total of those two is 91 Fights!
    Take this advice Manny and make Mayweather rue the day he tried to blemish your name.

    Manny had to sue them, since the lawsuit was filed you haven't heard anymore steroid allegations from the Mayweathers, De la hoya or Schaefer. They really didn't think Manny would go so far as to sue them. Now their mouths are shut. It's not so about Manny winning money in this lawsuit but shutting their mouths, letting them know he can't be pushed around and proving in court that he is innocent of all their baseless accusations.

    drop the lawsuit? you gotta be stupid to even think of such an option. what in manny's statements can't you understand?He said he is willing to submit to the test its just that he doesn't want to have his blood taken so close to the fight. get your facts straight scott. some people really do feel weakened when even less than 3ml of blood is taken. its something psychological. manny is speaking from his experience from the first morales fight where he felt weakened and dizzy after his blood was drawn 48 hours before the fight. why does he have to give in to their demands and gamble the most important fight of his life? as much as floyd is trying to make things perfect for this fight, so is manny. lets be fair everyone. if they are not insinuating that manny is on some kind of peds then they should have asked the commission to do blood testing for every fighter, not just for pacquiao.

    if Manny drops his lawsuit, Mayweather would fake his own death to avoid the fight. Lawsuit should only be dropped when the fight is over. I say to Manny, fight the best fighter around, request for the nevada commision to take your urine test everyday of the 30 day training period even if you will have to pay for it, do your best to beat your opponent the way you always do.

    The reasoning you have is money. Pacquiao already warned Mayweather Sr. the first time he opened his mouth that he would sue him if he maintained his foolishness that Pacquiao used drugs. He not only didn't stop saying it, he influenced his son, his son's adviser and promoter to continue his assertion to the point where many of the public assume Pacquaio is guilty. They call NSAC a joke, which implies they themselves have expert knowledge. How can this not be an attempt no to try and tarnish Pacquiao's image. There is nothing wrong with an opining and exercising that right, but when you insist on having additional blood tests, intentional discredit the reputation of or an organization known for having a history being one of the strictest drug testing agencies, it's is an attack. All you want is to see the greatest two fighter of the decade in the ring. But what do you expect a fighter to do? NO Pacquiao should not drop a case he has a very strong chance of winning.

    I don't think his going to drop the lawsuit for whatever reason ... it's that mentally we have that you don't embarrass or have an asian lose face they will take that personally, it's diff from western culture its not money anymore its honor for Pacman to proceed with the libel suit also it would have a counter psychological effect on Mayweather if his playing head games this one is costly and a migrane

    Of course what is lost in these arguments and might actually help manny in his law suit, is that Golden Boy is guilty of doing the same thing Manny is doing. In 2008 Zab Judah requested that Shane Mosley take blood test befor their upcoming fight, and GOLDEN BOY PROMOTIONS REFUSED!!!! Now a 1 1/2 later Richard Shaffear and even Oscar himself have come out publicly insulting Manny for denying the same test that they denied for Mosley. Who in the hell do these people really think they are. And even worse, no one reported on it in the media when it happened, and still no one reports on it and the double standard. I guess all the reporters and writers are afraid of the big bad GB corportation.

    NO! Mayweather should fight Pacquiao and accept Pacquiao taking the additional blood tests and random urine tests he's offered beyond what NSAC mandates. Urine testing is proven to have the best methods for detecting PED's. There is nothing that wouldn't show up immediately following the fight in a blood test that would show up before the fight and help a fighter during the fight. But this is not the most compelling reason Mayweather should fight Pacquiao. The most compelling reason Mayweather should fight Pacquiao is that it would take most of the steam out of the Law Suit. The Law Suit's impact on the defendants will be based on real and potential earnings Pacquiao can make. If they fight and make the most money any boxer has made in the history of the sport how can Pacquiao claim he damaged his earning potential?

    Who cares about his chances of winning the case? He's doing what he believes is right. That's what's important.

    Anyway, how did you come up with the conclusion that it will be "fruitless"? At the very least, the lawsuit is a deterrent so that the rest of the brainless would think twice about making the same offense. Would you like see defamation become an acceptable norm in this sport?

    The fact alone that Floyd and Co would be hailed to court to answer the charges is a sort of moral victory on the part of Manny Pacquiao. More so, Just imagine the stress to be in the courtroom and putting up the finances to pay for your lawyer's legal fees.

    In some cases, if the defamation suit is entirely baseless and that the defendants never uttered words alleged to be defamatory, the court may adjudged that the cost of suit will be handled by the plaintiff. But then if it is proven that defamatory words were in fact uttered by the defendants it just that they could not be convicted owing to the absence of actual malice, they cost of suit may be handled by both sides. And this is very unfortunate for the Mayweathers, Flod being known to be cash-strapped. On the contrary, Manny Pacquiao is as liquid as the amazon river.

    A penniless Mayweather is good for boxing because that's the ONLY way he'll stick around to fight the guys we want to see him fight. Mayweather is a coward but he is an excellent boxer who can provide us great fights. Even if he loses to Pacquiao he shouldn't retire but continue fighting the like of Cotto, Mosley and Paul Williams. If Mayweather has the money, he won't fight anyone anymore. SO absolutely, Pacquiao should go through the lawsuit even if the fight is made.

    I agree this author must be a Mayweather fanatic. Instead of insisting for Pacquiao to drop the lawsuit, why don't this author insist for the Mayweather and GBP to make a public apology and drop their frivolous demand on random blood testing. Maybe Pacquiao will drop the lawsuit and for the fight to go on. To me, I say forget Mayweather and why give this undeserving dick a good payday. He had his chance and he blew it again. Ducking all to welterweight as he always done.

    These writers don't really think what they write. They keep on comparing this guy to other guy which has no similarity in the case at all. Those accusers who believe that the accused has something to prove are insane coz if that's the case, i could tell anyone he is a liar and ask to prove it if he's ain't. Now, this is the uneducated way. For me, the only way to come up with the truth is through the court of law which is why we have them. Now, the burden of proof is now being thrown to the Mayweather's and GBP, otherwise we shouldn't have the judicial system.

    The Pac vs Floyd Jr bout can only be made if the Mayweathers and GBP will recant their stories, admit they are liars, and publicly apologize to Pacquiao and the Filipino people.

    Other than that, Mr. Heritage, your opinion is not shared by the majority. And when I say majority, to Pac and his people.

    The lawsuit holds unless otherwise.

    This will be good news for boxing because if he's got no more money, he'll fight anybody for pennies and he's not gonna be concerned of his 0 record anymore. GOOD.

    Most of the Media of Boxing/Sports helped Floyd Sr., the Mayweather Camp, Schaefer, De La Hoya, Malignaggi, Cintron in painting a picture to the eyes of the general public that Emmanuel Dapadrin Pacquiao of the Philippines is a fake, and a product of use of performance enhancers in the sport of Boxing.

    Even without any hard evidence to back up the accuser's accusations, the damage has been done to Pacman's name and the sport of Boxing...most of the media/boxing community ran and contributed with it over and over and over.

    Adolf Hitler said it best about lies.

    If Team Pacquaio have not yet filed suit against these accuser's, I believe the media would still be running with over and over again. Enough is enough.

    I would never want to see the next future face of boxing be treated like this off of baseless accusations from his boxing peers again.
