When people find themselves under a CPS "investigation", we are SHOCKED. We grew up watching crime and court dramas on TV and we have the idea that in America, the justice system is fair and impartial. Some of us even know about Constitutional Due Process. We see the television coverage of major criminals' journey through the justice system, and it looks like they ARE receiving fair justice.
On the other hand, the end of the "justice system" most people are likely to actually experience is Traffic Court. Certainly no "impartiality" there, is there? The cop says you did it (it doesn't matter if he is lying through his teeth), and that's it. The "judge" finds you "guilty" and fines you.
The traffic courts I have been in were more like the checkout counter in a grocery store than what you would think a court is. The system is "doing business" with you. Difference is, they don't have to advertize to entice you to buy their "wares".
We figure- "OK, no big deal. Not a lot of money. Car insurance will go up a little. Not the end of my life". But in the back of our mind, we know it just isn't right. This is not what is supposed to happen in America. Something is WRONG.
Several years ago, I became aware that these are "Administrative Statute Law" courts, which have absolutely nothing to do with Constitutional Due Process. In other words, unconstitutional, not that any bureaucrats feel constrained by the Constitution. In fact, they consider the Constitution rather old, un-Progressive, passé and inapplicable to modern life.
I was a building contractor in 1974 when the building permit system went in force in Oregon. Supposedly it had been passed by a vote. Nobody remembers voting for it. Prior to that time, if you wanted to build a house or other building on your property, you just went and did it. You didn't need permission from anybody. That was called Freedom and Liberty.
One month in 1974, the projects I was working on were perfectly legal. The next month, anything new I started were "Out of Compliance with the Law". I was supposed to submit engineered plans for every project, PAY A FEE, and get their PERMISSION before I turned over a teaspoonful of soil. Worse, the "inspector" they hired had been one of my COMPETITORS who had "turned his business over to his son" so he could take the new Communist job.
Even worst, he had always been the sloppiest, most crooked building contractor in the county. Figures.
Being an old fashioned American, I just said "To Hell with them" and went right ahead building new buildings. What can they do? They have no real power.
This is where being an old fashioned American with quaint ideas about Freedom and Liberty can cause you to receive an unwanted education in how the Communists have taken over America.
No, the building codes Communists have no power. They can't MAKE you do anything. No, no, no, it's much worse. They write you a Citation into the State District Court. A "judge" ORDERS you to "comply". He can't MAKE you do anything either. Keep it up, and then the "judge" finds you "In Contempt of Court". Keep it up, and they send Billy Jo Bob the low IQ Sheriff's Deputy (with a gun) to arrest you and throw you in jail. Give him any crap and he will make you DEAD.
The unconstitutional Administrative Statute Laws have no power. It's the LEGAL ABUSE for "failure to comply" that will beat you into submission.

Now, I told you all that to tell you this-
There is another Communist bureaucracy out there ready to "do business" with you on the phoniest pretense. It's called Children's Protective Services. An anonymous caller is all it takes, and you are in the fight for your life. The CPS agent sent into your life may call themselves an "investigator". That agent is no such thing. She is there to make the allegation stick to you, and any lie will do. These people should have jobs making up slander for the tabloids.
Back to the title of this essay, "What rights does a cps worker have?".
CPS agents have NO power. They can't make you do anything.
But that CPS agent has a tool you might not know about- The Poison Pen. The CPS agent writes up her Character Assassination on you and files it in court as an Affidavit. It's "Gospel". The "judge" isn't a real Judge, and his is NOT a Constitutional court of Due Process. It's another Administrative Statute Law court.
If you don't know what to do about it, you are toast.

I respect your "opinions", but when it comes to children, sometimes you have to act first and ask questions later. They can't protect themselves, so I'd rather take the chance and investigate than trust someone's word and a child ends up dead later.
That said, no doubt that many parents have been subject to unwarranted "witch-hunts". However, it's a fact that many children have been saved from abusers, addicts, and severe neglect by the work of these investigators.
I'm thinking Candace must be a CPS agent of some sort. The truth of the matter is that social workers are not to remove children from their homes unless there is a 'clear and present danger' to the child. CPS often removes children based on what ifs and mere supposition. That is not legal, however, as we all know, at least those of us who have been targeted and our families torn apart, CPS blatantly violates laws and they get away with it because family court judges and commissioners rubber stamp their every whim and wish. CPS agents often lie to judges in order to obtain a courts order to remove children from loving and non abusive parents. And then the nightmare begins. That is when CPS begins its witch hunt. Their routine staff of 'treatment providers' willingly parrot the social worker's agenda. They of course want extended contracts because that is how they make their livings. They can render 'opinions' absent concrete evidence to back their assertions.

It may also come as a surprise to learn that in Germany in the early 1940's the Nazi's had a "program" called ""Schutzhaft", which is directly translated as "Protective Custody".
It has always been a crime to injure people or kill them. No matter how fascist and "proactive" CPS is, they aren't going to stop ANY crimes from happening.
What do you propose to do about the nightmare of the thousands of legal orphans CPS have created, who are 11 times more likely to be abused in state care than they are in their own homes, and 7 times more likely to die as a result of abuse in the foster care system?

Go on your computer and find the place where you can check out "State Licenses" and put in the names of the CPS caseworkers and/supervisors in your state. You will find that most of them possess no license whatsoever, and furthermore in Michigan all they received was a few weeks of "training". That is possibly the same in your state. In Michigan they are protected by the union so they can operate with no licensing or proper schooling. Only after I went to the state licensing board and started complaining in 2004 did they change to hiring only licensed social workers, however, because of the union they still have the non-licensed people workeing as CPS caseworkers and supervisors. Wouldn't you be shocked if they allowed physicians to do the same thing? Aren't our families worth more than untrained, unlicensed caseworkers?
My family and I have personal experience with CPS. They are nothing less then criminals, and the crimes they commit against innocence parents and children warrent the death penalty. We are talking kidnapping, conspiracy, and fraud against the federal government. They lie, threaten/coerce, and are bias. They are adversarial and hostile at best when the force you to "volunteer" for their services. If our forefathers were to hear of these criminals they would get out their shot guns. We must together stop them.

They think they are GOD! Our excuse for a caseworker lives in a HUGE house, directly purchased from the DIRECTOR of the county's human services dept. She has NO license whatsoever & less than a bachelors degree, and couldn't cut it as a certified nursing assistant (probably abused elderly people). Yet, she's got it made at dhs. Funny how regular people are losing work, having pay cuts, while this evil thrives & prospers.
No, Candace. It isn't "many parents", but 60% of "witch hunted" families involved in the system. If the system did its rightful duty of working to keep families together, there would be no need to REFORM THIS SYSTEM. Child Protection Services is a misnomer and is the biggest, rotten and corrupt system with arsenal of so-called social workers and their supervisors in cahoots with the psychologists/psychiatrists, police and legal players so much so that it no longer resembles ANY kind of "child protection". The system is only as workable and good as its members allow. My opinion: CPS workers - on the whole - are not any longer "human". They are the real damaged and have gone on to damage the innocent. NO CHILD SHOULD EVER DIE IN "PROTECTIVE CUSTODY" in the system. NO! NOT ONE! Period. What does it say of you who are a part of that system then? Its flawed beyond repair. It needs to be replaced by REAL HUMANS rather than immature, damaged, politically corrupt ass kissing minions. Period.

This brings to mind an extra I saw on the news this past summer. These folks had searched for a peaceful community to reside with their two children. They settled into a home accross the street from a park. The homemaker wife would let her kids go accross the street to play as she could see them from her kitchen window. One day she had CPS knock on her door! Shocked of their presence she had been informed someone had phoned in somthing to the affect of unsupervised children. Though the parent observed the apparently harmless park worker approach her children. In the end the parents won their argument of where's the law kids can"t play in the park? The schools will make them walk a mile home but they can't go to the park accross the street alone? I belive they held CPS at bay at "bay" I say because your loked in for at least a 5 year time period. A period in which they will monitor your activities like spies!.

my daughter was diagnosed with depression. We thouught by putting her in the menninger clinic whichnis cash only 3 weeks for 23,000.00 wrong they went on a witch hunt on how we were as parents. I have a broken foot and get injections i am nmot to drive myself home and have panic attacks so i take a zanax when i get home. They called me when i got home and said i slurrres my words.. WE got our daughters diagnosis about 2 ans a half weeks in. My dfaughter started calling home begging to come home but would not say why so my husband went down and told the Dr, that he did not know what was going on but my daughter has never been that terified in her life and he was taking her out.. Tjhey called cps and we were told we took her out ama. and that i had slurred my words. I am dying of a liver disease.. Thjey made myn husband and i take a drug test....I am positive we past. Now what will happen we are terrified...
