Parents rights activist Murtari imprisoned for chalk protest, and released

Update 11/18: John Murtari has been released from jail, with none of the usual pre-trial conditions.

Original article:  Parent activist and founder of akidsright.org, John Murtari was arrested today in Lyons, NY after a peaceful protest for family rights. 

Murtari started this family rights protest for the You're the Parent Notification Act in early Oct. by writing with children's chalk on the walkway in front of Assemblyman Oaks office.  That didn't end in arrest, so on Oct. 26 he moved the protest to the sidewalk in front of the Village offices police station. 

When that family rights protest didn't get the result he wanted, he moved his campaign to the Wayne County Courthouse in Lyons.  On Nov. 9 and 10 Murtari taped Declaration of Family Rights posters to the building and wrote on the ground with chalk. 

On Nov. 12 Murtari wrote "HELP FAMILY RIGHTS" on the courthouse building with chalk.  He was arrested for graffiti (a misdemeanor, Section 145.60(2) of the New York Penal Law) and released.

Today he returned and continued to write about family rights on the Wayne County courthouse wall.  He was arrested, and is now in custody at the Wayne County Jail in Lyons,  NY.  He has a court date at the Wayne County Courthouse in Lyons on Nov. 25, and hopes supporters will be there to court watch.

Murtari is probably best known for refusing food and water while incarcerated in 2006 for child support arrears he says he did not owe.  Murtari was given a feeding tube after his blood pressure dropped so low a reading couldn't be taken.  He endured 123 days without food or water, and enjoyed his favorite ice cream sundae the day he was released.

    § 145.60 Making graffiti.
    1. For purposes of this section, the term "graffiti" shall mean the etching, painting, covering, drawing upon or otherwise placing of a mark upon public or private property WITH INTENT TO DAMAGE such property.

    They CANNOT ever get a conviction on him if he goes before a jury! They know it, but they figure with enough intimidation and deprivation of liberty (i.e. torture, kidnapping, hostage holding), that the can get him to plead guilty. Knowing the pirates, they will delay, delay delay, until he has served a longer jail sentence than most convicted child rapists, and then offer him a "deal" to "go home today" with "time served". Evem of they dismiss the charges, he still serves a jail sentence, which is just plain wrong and anti-American. Who is "anti-government"? The protesters or the lawless criminals wearing uniforms??

    What a foul, evil, twisted, corrupt system we are enslaved in. America is destroying itself.

    Do you know how I might contact the gentleman who was tortured in South Carolina? There is a case on record preventing this type of stuff, a family court judge has been overruled and there is case law preventing this. I would love to provide this to Mr. Barde so he may proceed with a lawsuit, if he has not already done so. thanks, frances lucas

    Dads are being incarcerated for non payment of child support despite job loss and disability because they can't get their
    child support orders modified even on a temparory basis. Incarceration doesn't stop the arears either. Incarceration only serves to make things worse by discriminating against future employment and devastinging emotional distress

    Family courts across america are abusing their authority, violating due process , civil rights and parental rights.
    It's our children that are suffering the most.
