Family rights activist John Murtari was arrested Wednesday afternoon for graffiti, carrying graffiti material and trespassing while standing on the sidewalk in front of the Old County Court House in Lyons, NY. He had written "MR. OAKS HELP FAMILY RIGHTS" on the brick building with children's chalk earlier that morning. (See photo below.)
Murtari has written the same message in different parts of town, including the Wayne County Hall of Justice across the street. See NY family rights activist chalks on courthouse. (Photos) These actions are part of Murtari's ongoing quest to get Assemblyman Robert Oaks to take up the family rights cause.
This is not Murtari's first arrest in this campaign. See Activist incarcerated, $1k bail for chalk message. After Murtari's attorney, Ms. Denise Munson pointed out that writing with chalk didn't meet the criteria for "intent to damage" the criminal charges were dropped.
In a sign of good will, Murtari has offered to clean the chalk off at the end of each week. On Tuesday Murtari said, "I asked security guards for a bucket of water and rag so I could clean off the messages. They told me not to worry about it."
Murtari is an ex Air Force Academy training pilot who nearly became a priest. He's divorced with a son, Dom, 17, with whom he shares a close relationship. Murtari's driver's license was suspended over child support arrears that he disputes.
"It is an absolute indignity and I refuse to be a willing "bag lady" as I walk around town for groceries. I can't take care of my obligations," he wrote in a recent newsletter. "This indignity is just a side effect of our failure to recognize Family Rights, but it helps provide motivation," he added.
Murtari has been examined by several psychiatrists during his jail stays, and has always been found to be of sound mind. He's currently being held in the Wayne County jail in Lyons. I just spoke with john on FB last week..He's looking for justice and he doesn't know any other way to get their attention. He's not being destructive for any other reason than to seek attention for what his rights should automatically be. This is what the government does, they push you until you haven't got any other options, than to lash out. They set us up to screw up. that's exactly what they want. That is how they keep us in check, so that they keep us in their screwed up system. This guy is a very good person, he is just sick and tired of being walked on by his government that was originally put in place to "Protect and Serve" the people of this Country..Now they've put so many "Nuts" in office, It's like having the patients run the "Insane Asylum!"
Writing on the wall of a public building is one thing, being charged with trespassing for standing on a public sidewalk is another. Sidewalks are "public ways", and John has as much right to stand on a sidewalk, or the grounds of the court house or any other public building, as any judge. They are violating his first amendment rights in an attempt to silence his dissent.
The arresting officer and any judge who upholds John's arrest should be canned. John is excercising his constitutional rights, the officer and judges are violating them. Violating their oath of office, too.

Joe makes me so proud to be an American. Not the local gov't though. Once I was a child of divorce parents, I have family that work in the divorce courts and know far more than most. I Joe was my dad, I would brag about it and tell everyone. I when the public realizes how bad fathers are treated, they make a larger than life statues of Joe outside the gov't buildings he has advertised his sufferage.
