Best interest of the child- A new "Civil Right"

Last year, I was cleaning up my computer desktop.  One item I came across was a poignant photo of a FLDS girl alone on a bus waving goodbye to her home and the life she knew.

As I was looking at this image, it struck me that- This IS a photo of the "Best Interest of the Child".

And then it struck me- This is a NEW Civil Right

That is, the child has the "right" to have her life decisions made for her by government.  HER "BEST INTEREST" CIVIL RIGHT

The term "In the best interest of the child" itself originates in the 1959 United Nations Declaration of the Rights of the Child, Principle 2 and 7.

The term is in the 1990 UN Convention on the Rights of the Child -

(Article 3, paragraph 1)
In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.

On February 16, 1995, Madeleine Albright, at the time the Clinton administration's U.S. Ambassador to the United Nations, signed the Convention, against massive protest by American families. The United States has not ratified the CRC.  (We never want it to be ratified.  See the Parental Rights Amendment  Lots more info at http://familyrights.us/UNCRC/)

But the "Best Interest of the Child" concept under Parens patriae was fully implemented in the United States beginning with CAPTA '74.  So the truth is, the Convention on the Rights of the Child has been supplanted into law and already DE FACTO in force.

"The best interests test has long been the subject of academic as well as judicial criticism for being indeterminate, providing little guidance on how to weigh the different needs of individual children, especially as they change over time"; Robert H. Mnookin, Child-Custody Adjudication: Judicial Functions in the Face of Indeterminacy, 39 Law & Contemp. Probs., 226, 257 (Summer 1975).

There is likely no phrase in our language more dangerous to children than "the best interests of the child", because it's the banner enabling the unconstitutional government officious and tyrannical intrusion into families. 

European Socialism's Best Interest Rights of the Child?  

I would much rather give American children their CONSTITUTIONAL Fourth Amendment Right "to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

    Hi Cheryl!

    I think it should be a prize winning photo alright. Whoever took this photo certainly deserves the credit for it.

    Do you know what the photographers name is? What was the photo named? I searched Google Images, Yahoo Images, and Bing Images for hours looking for anything about "FLDS, girl, child, bus" and found nothing close.

    I was thinking perhaps it was a screen shot from a news video at the time, probably in April, 2008

    Yea they say it is a new civil right however they are still not using it. They don't care about childrens civil rights only how much money they can bring into DHS/CPS and the other names they are called.

    The "best interest of the child" seems unconstitutional. There is no equal protection in family court. It seems like the best interest of the family should be subsituted for the best interest of the child.

    Thank you for drawing more attention to this important issue. Most parents do not realize the storm that is brewing. First, it is the marginalized parents who will lose their rights. Soon, it will be other groups who disagree with the government and will be told how to raise their children by the government.

    This is best interest of the child here in Odessa, TX:
    "...The'MO stated that she does not have reliable transportation to pick the OV up from the police station..."
    "...Deputy Mitchell said (Me)told Law enforcement to release (Daughter) to the people she was with because (me) did not have reliable transportation..."
    What was I supposed to do at 2:30 in the morning? Steal a car? Walk? Hire a taxi to go 100 miles?

    This is what CPS has decided to base their case on:
    "...The OV(16 yo f) ran away and MO/AP will not come get her from the Police station." False Reporting
    "...(me) stated she was not going to pick (daughter) up..." Again False reporting
    "... (me) stated to Hector Medina she was not going to pick her up..." Again false reporting.
    "...Jennifer said to RTB RAPR of (daughter)by (me)because (me) expressed she would not go pick up (daughter) for Big Lake, TX." Again False reporting.

    ..."The MO told the PD to release the OV to the boys that she was with." That was my only option at that time. "The PD did not feel comfortable doing this." On what grounds did he have to "not feel comfortable" with releasing her to her friend? "The PO has no reason to hold the OV at this time or to place the OV in juvenile hall." They said they had no reason to hold neither her nor her adult friend, they wouldn't even hold her for a few hours allowing me time to get a way up there.

    Here's some more "best interest". She is due to give birth in a couple of weeks around strangers who are salivating to get their hands on a beautiful, blonde haired, probably blue eyed baby girl who's "going to be better of with two parents instead of one". The baby's daddy is going insane because he can't get to her, she's having blood pressure issues and can't go to school or work I don't wanna hear about the dogs
    it just makes me sad
    im so home sick its depressing
    I got put on bed rest because of my blood pressure
    so now i cant go to work or school

    I don't have a phone to talk to them on and I can't
    just say gee donna can I call some church people my mom
    wants me to talk to because they dont know i talk to you
    and once they find out i talk to you theyll tak my internet
    away again and ill have no1 to talk to :[[

    In my experience with the family courts, the child is NOT in the est interest in the courts eyes. It really angers me that this is happening in our country and it really angers me that children have become the silent victims. God will strike them all down for what they are doing to the children of our families. Our children are our future and the courts treat them like they are not there,( INVISIBLE), all for money in their pockets.
