Proposition-8 goes to court again

A federal court Tuesday ruled that the official proponents and campaign committee for Proposition 8, ProtectMarriage.com, will be allowed to intervene federal court against a Hollywood-backed lawsuit designed to tear down California’s voter-approved marriage amendment.  Alliance Defense Fund will represent the group.

A foundation led by a Hollywood-area public relations firm that frequently represents celebrities and their causes is backing the lawsuit, Perry v. Schwarzenegger, which attorneys for two men and two women in same-sex relationships filed with the U.S. District Court for the Northern District of California, on May 22.  ADF attorneys filed a motion to intervene in the case on behalf of ProtectMarriage.com on May 28.

“In America, we respect the results of fair elections.  This latest lawsuit is yet another attempt by those who want to redefine marriage to achieve what they have not been able to obtain,” said ADF Senior Legal Counsel Brian Raum.  “We look forward to vigorously defending the definition of marriage that has existed since the founding of this state, that has been affirmed by the people, and that has been upheld by the courts.”

“This ruling designating us to defend Proposition 8 reflects the unfortunate fact that, if left up to state officials, the will of the people would not be defended at all,” added Pugno.

In its order granting the motion to intervene, the court scheduled a conference for Thursday to discuss details with regard to how the case will proceed.  The court noted that the California attorney general was not defending the state’s laws as contemplated in the California Constitution.

    In time, Prop 8 will be repeal, and all anti- same-sex marriage laws will be struck down federally. You're on the wrong side of history. No matter how hard you fight to slow civil rights, they will come. You didn't stop blacks from going to white schools or from marrying white people.

    The California constitution requires the attorney general to uphold the law including the state and federal constitutions. The AG rightly believes that Proposition 8 violates the federal constitution and has therefore responded as such. This is EXACTLY what his jo requires.

    Flex please mind your language, you should not move to Vermont, Iowa is nice though, if you like country, I think this (self censored) person should move to Iran, Saudi Arabia or the like were women are taught their place and wear a bag over their head they're very religious I have been told and he would love it I'm sure. Anyway you're on the winning side and then they will have something else to shove.

    "In America" we have a REPUBLIC with courts, legislatures, Governors, and voters. The courts are there to insure that minorities are protected from discrimination. Filing a lawsuit against this legislation is EXACTLY what our founding fathers would have wanted. Since when did America become mob rule wins? Maybe you shouldn't have slept through civics class in 9th grade.

    If youn arenot happy with your states laws make residence in a state that you do agree with the law. Is this to simple! people do it because they don't want to pay state taxes...
    So why force the issue of the minority u were out voted live with it or more!

    Sorry, you shouldn't be forced to move out of your state because it's full of bigots. That's not how America works. If you don't like gays, move to somewhere where there "aren't any" like Iran. We have civil rights in the country, and they're rightfully growing. Would you feel comfortable telling blacks in the 50s to move out of the South if they want rights?

    Prop 8 vote wasn't fair. Churches were abusing the privileges granted to them as tax-exempt, non-political organizations. And California's initiative process for amending the state constitution is broken; Prop 8 is just one of many ridiculous amendments.

    It is, and I don't have a problem with that. In a just and democratic society, the majority does not have a right to take equal protection under the law away from minorities.

    Prop 8 is mob rule, and in American, we don't want to be ruled by mobs, we want to be ruled by laws.

    Nobody, and I mean nobody has the right to tell an entire minority group - recognized and protected by our United States Constitution - that they are inferior beings and that they need to physically remove themselves from a State and move elsewhere. A few decades ago racism, xenophobia and recently anti-immigrant sentiments didn't respect ethnic minority groups and wanted these groups to "leave America!" Guess what? These ethnic minorities fought back and won the freedom to keep their American citizenship. So why tell a sexual-oriented minority groups - gays and lesbians - to leave the State they are citizens of? Most especially for gays who were BORN in those States, they have the right to live their. Some of you exhibiting such hateful beliefs only makes me want to strongly support gay civil rights more than ever before. Take care!
