Lindsay Lohan sues eTrade over commercial

Mean Girls actress Lindsay Lohan is suing eTrade Financial Corporation for $100 million over a recent commercial that features a baby girl using the terms "Lindsay" and "milkaholic". 

The commercial shows babies playing the markets and was aired during the Super Bowl to 106.5 million viewers.

In the Advertisement, a baby boy apologizes to his girlfriend through a video chat for not calling her the night before because he was busy on eTrade.  The camera switches to a baby girl who asks "And that milkaholic Lindsay wasn't over?"

Reports from the Ottawa Citizen say that Lohan is furious about the use of her "likeness, name, characterization, and personality" without her permission and that it violates her right of privacy.

Lohan filed her lawsuit on Monday in New York and she is asking for $50 million in compensatory damages and $50 million in exemplary damages.  She is also asking that eTrade stops running the commercial immediately and all copies of the advertisement are turned over to her.

Lohan's lawyer Stephanie Ovadia has not commented but she has suggested that Lindsay's name is unique in the same way that Oprah or Madonna's are.

When asked for a comment, an eTrade spokeswoman declined comment, saying that they had not reviewed the complaint.

A spokesman for Grey Group told the newspaper that the name "Lindsay" was after a member of it's account team and was not after Lindsay Lohan.

Lohan has had a long history of drug and alcohol abuse and spent three years on probation after drunk driving and cocaine possession.

    I think LL has a good point here, but for 100 million? Nevertheless, the biggest,greediest,and nastiest companies in the world are financial corporations. That being said, every opportunty will be taken to make fun of someone who is having a hard time in life and consistently makes news whether for professional or personally gains. In this matter, E+Trade is now getting more media attention due to it than before. Its what the industry terms free publicity. No one will associate it with Lindsey Vonn, or just a mainstreet Lindsay. This is the character of the nation as a whole. And it needs to stop. I bet e+Trade would have not gotten the attention if it were someone else's name and don't forget superbowl as well.

    Funny, I never even put Lindsay Lohan in any association to that commercial. I guess b/c I share the same "unique" name with Miss Lohan, and have often been referred to as a "milkaholic". How can she even think that? or sue for $100 million? I'd like in on that deal. I think my character has been degraded. You have to admit, it's a very funny commercial!

    Ms Lohan is way too full of herself. I have seen the commercial several times and never once thought of her or thought of it as a take off on anyone. It is a cute commercial. Lindsey is a common name now. Sorry, but she will never be a Madonna or Oprah, not in a million years.

    Lindsay Lohan is pathetic. I have seen that commercial a thousand times and never once did I think of her. She shouldn't flatter herself. Obviously no one cares about your miserable untalented life anymore or you would be working. She has really stuped low for a buck now.

    Laura: Let me start by sharing some light perhaps you don't understand. A man that owns "Milks a Million" in West Hollywood pay's people in Lost Wood to promo his business. This isn't nothing new in this culture. Obviously, if you were intelligent enough, you wouldn't be asking me this question. So this man, I don't know if he pays them in cash or in other types or forms of payment. You be the judge on other forms of payment. This was all captured on video long before the Super-bowl month and year turn around. The culture has encourage people to make fun of any one who is having a tough time in life especially if you are being used as an industrial tool. Still with me???
