Sandra Cantu case: Trial date set to determine whether slain girl’s autopsy will be released

A trial date has been set to determine whether the autopsy of murdered California girl, Sandra Cantu, will be released.

The proceedings are slated to begin on September 26, 2011 and will take place at the San Joaquin County Courthouse in Stockton.

According to the Tracy Press, last month a preliminary injunction was put in place to keep Sandra’s autopsy sealed. The family does not want the document released.

Nonetheless, those who have seen the report say the information included in the autopsy is included in court documents that were released last month.

Family attorney Stewart Tabak argues that Senate Bill 982, which allows family members to request autopsy reports and other evidence remain sealed if a child has been murdered, may prevent the need for a trial on the matter. The bill was approved on July 15 by a Senate committee, but Tabak was unsure how soon the bill would face a final vote.

Sandra, 8, disappeared in March 2009 and was found several days later stuffed inside a suitcase placed in an irrigation ditch not far from the mobile home park where both the Huckaby and Cantu family lived.

Huckaby was charged with the kidnap, rape, and murder of Sandra, but the rape charge was dropped in a plea deal with the prosecution. Huckaby agreed to plead guilty to the kidnap and murder of the little girl in exchange for a life sentence without the possibility of parole.
