Casey Anthony’s attorneys have asked Judge Stan Strickland to delay her fraud trial until her murder trial is over.
According to a motion filed Thursday afternoon by Casey’s defense team, “The complexity of the capital case necessitates a delay in the check forgery case.”
Casey is charged with stealing her former friend, Amy Huizenga’s, checkbook and writing over $400 worth of checks, including using the checks for a shopping spree at Target.
Two of Casey’s attorneys, Jose Baez and Dr. Andrea Lyon argue the defense cannot afford to waste time on a fraud case with the death penalty hanging over their client’s head.
They also argue there will be no harm in delaying the fraud case because Amy has already been compensated for her losses by her bank and Baez’s firm has reimbursed the bank with what is reported to be more than $600.
The motion also asserts that Casey has already served more jail time than a person who was charged with fraud for the first time would serve.
Casey is charged with the first-degree murder of her 2-year-old daughter Caylee, whose remains were discovered Dec. 11. Her trial is expected to take place sometime in 2010.

I HOPE THE JUDGE WON'T BE SO STUPID AS TO LET THE DEFENSE GET ITS WAY ON THIS MOTION.THEY HAVE ALREADY ALLOWED THEM TO DELAY THE MURDER TRIAL.AND TO LET THEM DELAY THIS ONE WILL NOT BE FAIR TO THE STATE OF FLORIDA.THIS DEFENSE TEAM FILES MORE MOTIONS THAN THE LAW SHOULD ALLOW.I SAY GET ON WITH THE FRAUD TRIAL.YOU GOT YOUR WAY IN THE DELAY OF THE MURDER TRIAL.NOW LET THE STATE HAVE THEIR WAY.JUSTICE DELAYED IS JUSTICE DENIED!
I could not have said it any better Argentina Rose...Let's get this going. This has gone on far to long already.
Rest in Peace Beautiful Caylee!
What difference does it make? Everybody knows about both cases and how the defendant's motives for both crimes are linked. She can continue to commit new crimes in jail for all I care; she's headed to her just death in very due time.
start the fraud trial now, what would it take? the facts are there as are witnesses and video, no big effort needed to defend this case cause there isn't a defense.
