San Diego Minutemen at their Adopt-a-Highway site
In a First Amendment victory for California, the San Diego Minutemen won more than $150,000 in damages for a lawsuit filed against Caltrans for revoking the groups Adopt a Highway permit.
“We are very pleased with the settlement which ends the 18-month attempt to discriminate against our political views that began in January 2008 by local illegal alien activists, Caltrans employees and members of the California Latino Legislative Caucus,” said Jeff Schwilk, founder of the San Diego Minutemen.
The settlement was reached on August 3 at the Federal Court building in San Diego.
Terms of the settlement include payment to the San Diego Minutemen of $157,500 for attorney fees and damages, permanent restoration of the AAH permit for the freeway site near the San Clemente Border Patrol checkpoint near San Onofre, full future participation in the California Adopt-a-Highway program and Caltrans will hold a press conference at their headquarters to correct the inaccurate statements made by Pedro Orso-Delgado, San Diego District Director, who coincidently announced his resignation from Caltrans on the day of the settlement.
Mr. Delgado could not be reached for comment and Caltrans refused to comment regarding the settlement in favor of the San Diego Minutemen.
San Diego Minutemen has been cleaning the San Onofre freeway site since August 2008 when Judge Hayes granted an injunction to restore the Minutemen sign and permit.
“SDMM is proud to participate in this community service program and we look forward to adopting other highways in San Diego County to help keep our freeways and roads clean,” Schwilk said.
Francisca Galvan, SDMM’s Adopt-a-Highway director and legal immigrant from Mexico said, “The San Diego Minutemen were extremely grateful to their attorneys at Kaloogian & Fuselier for successfully representing their American activist group in this important Constitutional and civil rights case.”

At the root of this weedy situation was the exposure of a conspiracy involving racist Latinos in the California Legislature and within CalTrans, and a disturbing influence by the Mexican Government. Sadly the award to SDMM was too low and the Government employees got a slap on the wrist with pensions intact. The punishments are not complete or fulfilled, leading me to worry, those involved shall rest uneasy. The desert rat should guard his tail.

No one should have denied Jeff Schwilk and the SDMM, their rights as Americans to express themselves and to protect our country, specially when politicians are not doing their jobs.

Perhaps you should change your posting name to "Trash Can Mouth". The Minutemen aren't harassing anybody. If they spot illegal alien lawbreakers entering our country, the Minutemen contact ICE and then let them deal with the illegal aliens. Apparently you support the illegal alien lawbreakers. It seems fashionable these days that our government ignore laws and promote crime by closing their eyes to the takeover of a great nation by third world masses. I'm praying for a leader that will have enough backbone to say, "we will no longer be the dumping ground of the world. Call your citizens home and do your job of taking care of them. We'll do the same." However, illegal immigration is far too profitable to the traitors in this country. For instance, Microsoft lays off thousands of workers, yet Bill Gates is constantly approaching Congress to import more Indians to fill his jobs. And I'll bet he thinks he's a patriotic American.

I hope that $150K doesn't end up in Schwilk's personal pockets. Where, exactly, is that cash going? Perhaps to pay that libel judgement against you? Will the lawyers post their bills and accounting so that we can all see where the money goes? Maybe new vests and trashbags so that the ORIGINAL purpose of the adopt-a-highway application is furthered.
