This week a tough new bill designed to aid local police and sheriffs arrest illegal aliens has advanced to the Arizona Senate. Wednesday's 4-3 party-line vote, with Republicans in the majority, sends the SB 1070 to the floor for a full vote. The move is the latest effort by Sen. Russell Pearce, R-Mesa, to force local communities to do more to find, detain, and arrest or deport, those who entered the country illegally. Much of the debate centered on allowing local authorities to stop and detain people suspected of being an illegal alien. The new bill would also contain the following provisions:
• Paving the way for law enforcement to conduct "sting" operations to find companies knowingly hiring undocumented workers.
• Making it a crime to stop a vehicle on the street to pick up someone to do a "day labor" job.
• Requiring police to make a "reasonable attempt" to determine the immigration status of anyone they contact officially if there is "reasonable suspicion" they are an illegal immigrant.
• Permitting anyone to sue a city, county or any government that has policies which limit immigration enforcement by their employees "to less than the full extent permitted by law."
John Thomas, lobbyist for the Arizona Association of Chiefs of Police, specifically questioned the section about officers being able to arrest suspected illegal immigrants.
"This requires federal immigration training," he said, referring to a section of federal laws which allows Immigration and Customs Enforcement to train local police to enforce federal immigration laws. That training includes being able to properly identify who is and is not in this country legally.
But Pearce said all police officers have "inherent authority" to enforce federal immigration laws, even without special training. He said the only time special training is required is after someone is arrested to determine their legal status. "Our communities need to do more to find, detain, and arrest or deport, those who entered the country illegally".
Arizona Republican legislators are trying to give local law enforcement more authority to stop and detain people that are suspected of being illegally present within the United States. For many years Federal immigration authorities have relied on local law enforcement to assist in identifying those that may be here illegally. It is only until recently that Sheriff Joe Arpaio has really brought the practice to a controversial head.
Under INA 287(g) of the Immigration and Nationality Act(INA) (that is,Section 133 of the Illegal Immigration Reform and Immigrant Responsibility Act (IIRAIRA) of 1996 titled "Acceptance of State Services to Carry Out Immigration Enforcement"). The Act describes the inherent arrest authority that has been possessed and exercised by state and local police since the earliest days of federal immigration law.
It has long been widely recognized that state and local police possess the inherent authority to arrest aliens who have violated criminal provisions of the INA. Once the arrest is made, the peace officer must contact federal immigration authorities and transfer the alien into their custody within a reasonable period of time. There are not enough nor will there ever be enough immigration agents to properly locate and identify all of the illegal aliens present within the United States therefore local authorities have played a neccessary role in immigration enforcement.
Pearce said, though, he's not necessarily looking to fill Arizona jails with illegal immigrants. He said it gives discretion to law enforcement officers whether to seek prosecution or simply turn offenders over to ICE.

AZ State Sen. Russell Pearce is a hero. He's tried valiantly for years against then-Gov. Napolitano to bring AZ into the 21st Century instead of being a state that had stuck its head in the sand, Invasion-wise. He is absolutely right. What he doesn't say is the fact that Sanctuary Cities--which don't allow by EO--a local police officer to ask someone they're questioning what their legal status is. That is simply insane, and it's allowed illegal alien gangs in CA, AZ and elsewhere to flourish. Sanctuary City ordinances are against Federal law. IMHO, it's time for lawsuits against SF, L.A., N.Y. and other large U.S. cities to force them to remove Sanctuary status.

Please don't tell illegals to go home and apply correctly. No one who broke our immigration laws every deserves the chance to come legally. If our government really wanted them to leave, the President would demand they leave. Wouldn't cost a cent to go home the same way they got here. Beware people of AZ..Georgia has some of the strictest enforcement laws in the country thanks to the honorable Chip Rogers bill to cur tel the invasion. But the reluctance of county and city authorities to enforce the law has required the Georgia state Senate to pass a new law stating that its against the law not to enforce the law.
Can you believe that? I submit to the American people that there can't be that many profiting from this modern day slavery that can't be overcome by shear numbers of patriotic Americans who love their country and our heritage and language and refuse to see it transformed to third world status.

Russell Pearce should go down in history as one of first - and longest lasting - elected officials with the courage to address illegal immigration. What is unfortunate is the fact that elected officials such as Pearce, Thomas and Arpaio must consistently overcome the resistance of corrupt politicians, anti-American organizations, such as LaRaza, LULAC, MEChA, etc., and religious/social service organizations that view illegal aliens as cash cows that work tirelessly to circumvent our laws - turning our country into a clone of the third world countries the illegal aliens left behind. If this bill is passed, look for the Barry Hussein administration, through its Department of Injustice run by the corrupt Eric Holder, to do everything possible to sabotage it. An immigrant has to be legal in order to join our military.
For example, they have to have a green card----and by them joining our military, the citizenship process is rushed through for them---and their families---when they are done serving their 2 years or 4 years---whichever it is.
ILLEGALS are NO WAY able to join our military.
Sue, their citizenship is not rushed through. The process of citizenship is terrifying. A guy with a "permanent residence" can be deported on the spot for crimes he may have commited when he was twelve years old. You don't even have to be arrested or found guilty as long as you admit you did it your gone. The bill you're referring to was HR 6020 the Hector Gutierrez act which was co-sponsored by nineteen congressmen and women. All from hispanic states. It never made it to a full house vote and was therefore not sent to the senate and then not to the president. The 110th congress never passed it down to the 111th congress. Therefore deportation letters are coming to those whom were willing to die next to me in combat to protect this wonderful amazing nation.

Seems to me like the common link between all of the stories is the criminal activity behind each one. (Felony weapons possession, drug possession) Some stories are not even written. CHE I think I didn't explain the situation right. See what happened was that before 1996 a Lawful Permanent Resident was had practically the same rights as a U.S. Citizen they just couldn't vote. Then they changed the law and made it retroactive so that people whom commited crimes of moral turpitude would be on a deportation list. This means if one commited a crime in 1972 and had paid his debt to society and had been good up until 1996 well he was now going to be removed. So he would have to leave his American kids fatherless and his American wife husband less here in America or he could take them with him to a third world country. It destroyed families. Because they had commited a crime in their youth. We all know how stupid young people are. Not to mention movies like Scarface and rappers like Tupac making it cool to commit crimes. Commiting crimes became a part of american fabric and freud would call this criminal behaivor a mating ritual of a teenager. Done to impress the female.

--Their is a big difference between an illegal alien and a legal alien that was brought here when he was a baby whom served this country. Deporting illegals is fine, but deporting vietnam veterans or iraq and afghanistan veterans isn't. Look at the wetback act passed by Truman. Unlike the other groups on your list, most of the "hate" that is directed toward Mexicans is because millions of them are in this country in violation of our immigration laws. It's difficult for Americans to warmly welcome any foreigner whose first act in our country is to violate our laws.
Aaron, I hear you in so many ways. But listen man, how can you blame the rage so many American citizens have? Try to imagine a situation, where Americans by the millions illegal enter Mexico, and start interfering with the jobs and culture that Mexico has. I have been to that nation several times. My father was a German businessman and he actually like Mexico, because he said that he was treated with respect there. I remember how he would buy a burrito or some other thing at one of those outside vendors, usually run by some poor Mexican woman, and yet he'd never get sick because the food was literally cooked over fire. He did this because he felt sorry for poor people, because he was a youth in wartorn Europe and survived by eating molded bread that fell off trains and was in the rain and sun for who knows how long. Illegal immigration isn't just an issue in the United States, if you use the GoogleNets regularly, and do a search for illegal immigration, today they just had a mass landing on the island of Corsica. Great. Now the immigration process is like D-day, just no guns. Yet.
Frankly, probably the best prophylaxis in the United States against run-amok illegal immigration, since neither politicians nor border patrol seem to really be able to deal with the phenomenon very effectively, is if our economy goes completely to the Hot Place, and stays there for about 20 years, or however long it takes countries like Mexico to put down the tequila bottle, and get their national act together. They can use some of their drug money, and buy some cargo boats and planes and stuff, and engage in legitimate trade with other countries. When Americans are broke, they can't afford dope, they just have to grow it themselves.
