Missouri Lt. Governor Peter Kinder takes on Obamacare

Missouri Lieutenant Governor, Peter Kinder, filed a lawsuit challenging the new health care law forced through Congress by Nancy Pelosi at the insistence of Barack Obama after ongoing opposition by the majority of American citizens and numerous tricks and special deals by the Obama administration, Harry Reid and Nancy Pelosi.

The suit was filed in Cape Girardeau on Wednesday, July 7th. The plaintiffs are Kinder in his capacity as Lt. Governor and in his individual capacity, Julie Keathley of Stoddard County, Dale Morris of St. Louis County, and Samantha Hill of Johnson County, east of metro Kansas City. 

The suit has eight counts and challenges the constitutionality of Obamacare relative to both the United States Constitution as well as the Missouri Constitution. Issues addressed in the suit include the allegation that Missourians will suffer reduced access to health care under the plan as well as the burden the unfunded mandate will place on the state.

Executive Director of the Missouri Republican Party, Lloyd Smith released the following statement:

Missouri Republicans have been at the forefront of protecting state sovereignty from the federal government’s onslaught of onerous regulations and mandates.  Thanks to the General Assembly, Missouri voters will be the first in the nation to go to the polls and make their voice heard against the Obama-Pelosi-Reid health care bill.  And now, Lt. Governor Peter Kinder has taken legal action, alleging that the health care bill violates the rights of Missourians from all walks of life.

We commend Lt. Governor Kinder and the plaintiffs of this constitutional challenge for their diligent work to protect Missourians and our great state from the worst parts of the federal health care bill—and for doing so at no cost to taxpayers.

Earlier this year the Missouri Legislature passed the Health Care Freedom Act (MHCFA) in a bipartisan vote with 108 members of the House and 26 members of the Senate voting yes on HB 1764, called Proposition C. Republicans were joined by 25 Democrats. Prop C will allow Missouri voters to give voice to their opposition to Obamacare at the ballot box in the August 3rd primaries across the state. 

Popular conservative blog, Red State, calls the Missouri Health Care Freedom Act the "Concord Bridge" of Obamacare repeal.

In Kansas City on Monday, July 12, 2010, local grassroots activists are sponsoring a Missouri Health Freedom Party from 5:30 to 8:30 PM at the Uptown Theater, 3700 Broadway, KC, MO, where they will feature a screening of the new movie "Don't Tread on Me". Some candidates for office will speak to the crowd, including State Senator, Chuck Purgason, co-author of MHCFA, who is opposing Roy Blunt in the Republican primary for the U.S. Senate seat to be vacated by Kit Bond.
