America, Liberty has won the day! Our Civil Rights, as stated in the Bill of Rights in the Constitution have been upheld.
Yesterday April 20th, the 9th Circuit Court of Appeals upheld the Second Amendment, the right to keep and bear arms, and incorporated that decision onto the states through the 14th Amendment. In a victory for constitutionalists and Gun Rights advocates, Judge Diarmuid O’Scannlain’s Opinion in the case Nordyke vs. King states in part the following:
“We therefore conclude that the right to keep and bear arms is “deeply rooted in this Nation’s history and tradition.” Colonial revolutionaries, the Founders, and a host of commentators and lawmakers living during the first one hundred years of the Republic all insisted on the fundamental nature of the right. It has long been regarded as the “true palladium of liberty.” Colonists relied on it to assert and to win their independence, and the victorious Union sought to prevent a recalcitrant South from abridging it less than a century later. The crucial role this deeply rooted right has played in our birth and history compels us to recognize that it is indeed fundamental, that it is necessary to the Anglo-American conception of ordered liberty that we have inherited. We are therefore persuaded that the Due Process Clause of the Fourteenth Amendment incorporates the Second Amendment and applies it against the states and local governments.”
This means in short, our right to keep and bear arms is constitutionally protected, and incorporates the states by way of the 14th amendment, and so the states in the 9th Circuit, Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington.
In his concurring Opinion Judge Gould stated in part,
“The salient policies underlying the protection of the right to bear arms are of inestimable importance. The right to bear arms is a bulwark against external invasion. We should not be overconfident that oceans on our east and west coasts alone can preserve security.” “Second the right to bear arms is a protection against the possibility that even our own government could degenerate into tyranny, and though this may seem unlikely, this possibility should be guarded against with individual diligence.”
This is a gem of a decision out of the most liberal Circuit Court in the Nation. Liberty has won the day!

A simple fact check would reveal to anyone interested that the decision was released yesterday, April 20, not today, April 21.
How does one make such a gross and obvious mistake?
If the author can make a mistake on the most simple and basic of facts, how is anyone to trust anything this person claims?
Is there no editor? Can anyone just throw up what ever crap they like without researching their story?
I thought the Examiner had more quality and class than what is being displayed here...
Thank you for the comment Olivia! I appreciate your commentary! I wanted to let you and all my readers know that I wanted to examine the entire Decision and opinion before doing an article. I had heard of the decision last night, but did not have access to the full decision. So in the interest of validating accurately the story, as well as getting direct quotes, I waited until today to publish the story.
You have my apologies for not doing so in a timelier manner!
That being said, it is still a great victory for Gun owners, and the right to bear arms, and fully deserving of any and all press it gets.
In the interests of ethical reporting, I will hold onto a story until such time as I can back it up with facts and corroborating information! Thank you for your feedback and input! You are instrumental in helping me become a better writer and a greatly appreciate that!

Your platitudes ring hollow. Your story is still in error. You claim you take your time and yet you fail to get the most simple fact right, and fail to correct that fact after being notified. The only word is "sloppy"; you are not careful, just lazy and sloppy.
Now please correct the story. In paragraph two you claim the decision was reached today, April 21; but the most simple fact check reveals the decision was reached yesterday, April 20.
Next time have some one proof read your text and save yourself the embarrassment.

I could not agree more Carl! With so many constant erosions of our Civil Liberties, it is fantastic to see one of the most fundamental guarantees we are granted, supported and upheld. That it comes from the 9th Circuit is something un-looked for, and a very pleasant surprise!
