Cars, quo warranto, and Obama (Update)(Update 2)

With so many lawsuits filed every day in America, one more might seem irrelevant. There is one however that should be watched, but will most likely escape notice. For a little while at any rate…

Last summer, hundreds of Chrysler and GM Dealers lost their franchises in the Chrysler bankruptcy sale. Many of those dealers vowed to fight what they saw as a heavy miscarriage of justice. It was simply un-American, and shocking to find that something like this could happen here, that the government could take over a private business, and then take that business away from hundreds of private dealerships. Many of those dealers had profitable businesses; in some cases those businesses had been run by families successfully for 50 years, in some cases more.

Neil Cavuto welcomed former Chrysler dealer James Anderer to his show on Fox Business News Daily to talk about a case that has been filed by a group of dealers who lost their businesses in the Washington D.C. District Court. (Update: Cavuto's show was guest hosted by Charles Payne who did the interview) Lead Plaintiff Anderer mentioned a team of legal experts while describing the case to Cavuto, and an anonymous source has named Leo Donofrio and Steve Pidgeon as having been retained by a group of Chrysler dealers who lost their franchise in the Chrysler bankruptcy sale. They have been retained to bring two actions:

1. A motion to reconsider the Court's approval of the dealer rejections.
2. A quo warranto in the D.C. District Court pertaining to Obama and his administration.

The Bankruptcy case will be brought in the Southern district of New York Bankruptcy Court, the Quo Warranto will be brought in the Washington D.C. District court, the only court in the nation where a Quo Warranto can be filed against a sitting President.

This case may initially slide under the MSM radar; however, it may be the single most serious case to be brought against The Obama Administration and the President himself to date.

    Using quo warranto as an indirect attack through civil law is a long shot at best. Another huge hurdle will be getting the DOJ to appoint a special prosecutor to go after Obama's ineligibility. Let us all keep our fingers crossed for Leo and the Constitution!

    Great post and I dearly hope it is true. Mr. Donofrio has uniquely held fast that to defend a Republic of laws it is imperative to unhypocritically apply those laws aptly.

    Taitz, Berg, Appuzo, et al have bastardized law, put forth incompetent litigation, and placed thier respective clients secondary to vanity and hubris.

    If I were preparing to enter into a significant QW challenge, I might suspend the entirety of my blog and "go dark".

    Fantastic news! Chrysler dealers who lost it all certainly are an "interested party" according to Leo's analysis. Persons who lost their profitable business due to no fault of their own can likely show injury. What's the defense? They didn't sell enough cars? The standing issue just might be resolved.

    My only question is since the DoJ already interjected itself into the issue by defending Obama, how is it the DoJ is the only authority that can appoint a special procsecutor? Isn't a matter of filing the QW in court and the DoJ having recuse itself because of a conflict of interest and therefore have no choice but to appoint a SP?

    I don't see how the media can ignore this one. Great job Dianna!

    The obvious question is why would the Founders include both “natural born citizen” and “citizen” in Article II, Section 1, Clause 5, of the Constitution which states the requirements to serve as POTUS, unless they recognized the two terms had different meanings?

    Americans must understand that natural born citizenship is determined at birth. A natural born citizen is one who is born in the U.S. and whose mother and father are both U.S. citizens. Persons with dual citizenship, such as Obama, are not natural born citizens. The Founders recognized some of their own group of Founders were not natural born citizens, so they included “or a Citizen of the United States, at the time of the Adoption of this Constitution” in clause five (5) to allow those who were not natural born citizens to serve as our first presid

    The Founders thought a citizen could serve as a representative or senator but they believed the Commander in Chief and holder of the highest office in the land must meet a higher requirement to serve in order to prevent the possibility of divided loyalties. At the time, many living in the colonies were loyal to Great Britain. Thus, the Founders imposed the requirement of being a “natural born citizen” for someone to serve as POTUS, to help insure the survival of the fledgling country.

    A similar situation today would be if Castro, Chavez or Achmadinijad came to the United States and fathered a child by a U.S. citizen. If that child grew up to become president, with whom would his/her loyalties lie – the mother or the father? Would the republic survive if loyalties lay with the father?

    I wonder if Leo will sign off on the documents as Leo Donofrio or The Paraclete?

    Anyone who believes a suit against GM to overturn a bankruptcy, which plan was approved by the bankruptcy court, can be back-doored into a birther eligibility claim really needs to go back on their meds.

    The other attorneys mentioned by a poster earlier, however, are hardly "bastardizing" their clients but are instead taking a differing approach from the barrister-pair in this instance. I surely hope that one or more of these approaches is successful. It's sorely needed by our country!! I see the "usual Obots" are chiming in ...

    Thanks for the article Dianna! Obviously there are a bunch of mindless Obots trolling. It is very important that these lawsuits make their way through the courts.

    The assault on our country is relentless. It is not about health care, it is not about global warming, it is not about CO2, it is all about power, power over another human being. We all have rights, rights given to us before the constitution. Those rights must not be taken away by the government. However, if a big enough crisis can be created, if enough panic can be created, if enough fear can be created, then the will of the people to resist collapses as we tire from the battle.

    Can anybody cite where Dononfrio is actually a practicing lawyer, or is he going to try the pro se approach?

    Is there a link to the Anderer interview?

    Isn't the window for appeal closed by now and didn't the rejection of prior appeals by the Courts enough of a hint.

    And finally, NBC and President Barack Obama used to drive a Chrysler when he was in the Senate. Is this how you repay brand loyalty?

It’s funny however that the so called ’liberals’ like you have no problems throwing them under the bus when it suits them. It’s much the same as the ’liberal’ argument of the ‘evil right’.
