Michael Jackson Estate says father Joe Jackson is not entitled to son's medical records

Amid ongoing litigation with the courts and the Jackson Estate, Michael Jackson's father Joe Jackson is attempting to gain access to his son's medical records in an attempt to file a wrongful death suit.

TMZ reports attorneys for the Estate are fighting the action for the following reasons:

1. Joe Jackson is not listed as a dependent of Michael and therefore has no right to sue on his son's behalf.

2.  The father is attempting to gain access to the records by making the request in a suit seeking an allowance from the Estate, which has nothing to do with wrongful death or medical records.

3.  Since the father is an entity totally separate from the Estate, he has no authority to override doctor-patient privilege and invade his son's privacy.

The "King of Pop's" pop is currently suing the Estate for maintenance, claiming his monthly expenses exceed $20,000 as he supports children, grandchildren and pays for travel, hotels, assistants, as well as and legal fees.

The New York Times claims lawyers for the Estate recently filed a motion against the 81-year old because the father "failed to show that his son supported him while he was alive."
