DHS Secretary reiterates commitment to immigration reform in 2010

Department of Homeland Security Janet Napolitano testified before the Senate Judiciary Committee Wednesday, and reiterated her comitment to work with Congress to push for comprehensive immigration reform in early  2010.

DHS Secretary updated committee members with her department's progress over this past year and emphasized that immigration enforcement is a necessity, but that enforcement alone is not a solution for a broken immigration system.

"We can no longer perpetuate a status quo that is unacceptable for workers, employers, law enforcement, faith leaders, and America as a whole. We must seize this moment to build a truly effective immigration system that deters illegal immigration, provides effective and enduring enforcement tools, protects workers from exploitation and retaliation, and creates a tough but fair path to legalization for the millions of illegal immigrants already here," Secretary Napolitano said. 
 

Immigration advocates and civil rights activists reacted to Napolitano's words.

The following is a statement from Frank Sharry, Executive Director of America’s Voice:

“In her testimony today and in recent speeches, Secretary Napolitano makes clear her intentions to put the Administration’s muscle behind the effort to enact comprehensive immigration reform legislation in early 2010.

"As [former INS Commissioner] Jim Ziglar and [former Assistant Secretary for Border and Transportation Security Policy at DHS] Stewart Verdery made clear yesterday, relying on enforcement measures alone amounts to putting a band-aid on a clean fracture. In order to significantly reduce illegal immigration, restore respect for the rule of law, and replace the chaos and exploitation of the status quo with the control and regulation of an orderly system, we need comprehensive immigration reform – the only practical and lasting answer.

"We are encouraged by the Administration’s continued commitment to advancing immigration reform next year, as well as Senator Leahy’s remarks and the work of other Congressional champions such as Senator Charles Schumer (D-NY) and Rep. Luis Gutierrez (D-IL) who are gearing up for early action in 2010. It’s long been time for politicians to set aside partisanship and do what’s right for the country by enacting a lasting fix to this important problem.”

The following is a statement from Ali Noorani, Executive Director of the National Immigration Forum. 

"Today Secretary Napolitano reminded Congress that she is counting on them to act on immigration reform so her Department can keep America safe. She recognized that as long as 12 million people remain outside of the system, the harder it is to achieve control over immigration and enhance security.
 
"Secretary Napolitano was clear in the urgent need for legislative action on immigration, as stated in her opening remarks: “We must seize this moment to build a truly effective immigration system”. She knows that with every day that Congress delays fixing our immigration laws, the task of providing effective law enforcement and national security becomes more difficult.
 
"We also welcome remarks by Senator Leahy, the Chairman of the Judiciary Committee, who acknowledged that most border and immigration enforcement benchmarks have been met but that enforcement alone “will not by itself solve our Nation’s immigration problems”. This sentiment has been echoed by national security experts, who in a press conference yesterday, stated that regardless of security achievements, the bottom line is that without immigration reform, the Department of Homeland Security is restricted from operating in a well-functioning system that controls immigration and secures the border.
 
"We expect strong leadership from the Administration and from Congress to move past rhetoric into concrete action. Americans are counting on their elected leaders to solve the country’s challenging problems. That means transforming our broken immigration system into a system that works, that treats immigrants fairly, puts the undocumented on a path to citizenship and enhances national security by directing our enforcement resources in ways that protects this country from harm.
 
The following is a statement from Mary Giovagnoli, Director of the Immigration Policy Center:
 
"Secretary Napolitano is looking forward, but her opponents are looking backwards to tired old tactics that haven't worked (...) She is drawing upon her experience to move forward, but that entails a shift in thinking and comprehensive immigration reform. We can all agree that the current system isn't working, but some offer solutions while others offer the same old ideas."

    I'm what haters call Illegal alien. While they think we're draining warefare most of us are paying incometaxes which we never claim back, we pay taxes in every aspect of life; we don't have driver license and we carry money in cash beacause we can't open a bank account. We'll never claim warefare from government since we put ourself in risk of being deported, plus there is no way to do it. That's what they call living in the shadows. How can possible an american citizen or a legal residen feel that we are competition for a job place? .We accept we broke the law when overstayed our visas or cross the border without permit. Not beacuse we are lazy people who don't want to make it the right way. it's just beacuse THERE IS NO WAY!. They say enforce current laws Period!!. But just beacuse the law exists doesn't make it right. We're not criminal. we didn't came to robe anybody, we came to make our lives better as well as this country.     Overpopulation, congestion, urban sprawl, crumbling infrastructure, diminishing resources, energy shortages, lack of affordable housing, overcrowded schools and hospitals, vanishing farm land and green space, crime, pollution, depressed wages, increased tax burdens, the balkanization of our communities, the marginalization of American workers, taxpayers and voters, the overall decline in quality of life, are all the result of unconstrained immigration. Regardless of how the 'cheap labor' interests and 'mass immigration advocates' try to spin this debate, no one can arge that 'too many people competing for the same limited resources is sane, sustainable social, economic, or environmental policy'! Indeed, there are no problems confronting America's citizens that would not be measurably improved by securing our borders and enforcing our immigration laws. Like it or not folks, our resources are finite. All growth is ultimately finite. Better to address the problem of overpopulation now!

    I think you are misinformed. yes there are people who work under the table. which is actually a disadvantage beacuse they can not claim overtime, they have to accept low payment and they can't build credit. Regarding medicare ther is just no way you can do it even witha fake SSN. Housing: only non profit organizations help illegal aliens. Kids who use federal money is beacuse they were born here. Regarding schools yes that is a problem that could be solved by an immigration reform where then former undocumented immigrants contribute fully and legaly to the city county and state. by the way WE ARE very thankfull for allowing our undocument children to go to school. I know it comes from legal taxpayer money but if they don't go to school they would become a social problem eventually. lets work together for a better country Please support immigration reform with a path to legalization.     The truth is that illegal aliens contribute only a small portion of their costs in the taxes they pay. Add to that the billions in remittances that are sent outside our nation, billions that are never seldom taxed by the U.S. and never taxed by the receiving country, and the scope of this disaster rapidly comes into focus. Indeed, one of the big draws for illegal aliens is that they get to beat the tax man in both countries.

    Napolitano should resign and the statements that benchmarks have been made is absurd.
    This admin and the past demoralized our border patrol and ICE.
    Lastly with the unemployment growing and the demands being made at the Coppenhagen Treaty for population control an amnesty is unthinkable and most likely a moratorium on immigration is warranted.

    Even though the unemployment rate edged downward in last week's jobs report, an economic recovery is not yet underway, said Olivier Garret, CEO Of investment consulting firm Casey Research.

    In an interview with CNBC.com, Garret does not expect that there can be a solid economic recovery until there are signs that profits will return to companies based on sales, not cost cuts, and that more jobs are on the way.

    "Where are the jobs going to be created going forward?" Garret asked. "Entire segments of the economy don't exist, or are completely outsourced. It would take years, at best, to bring those jobs back to the U.S."

    Not only does Garret expect job growth will be hampered by employer expectations that taxes and interest rates will be on the rise, he expects unemployment will hit 12 percent next year.

    Problem is, Indu, you WANT all those things, but WE'RE the ones paying for them. We subsidize illegal aliens and legal immigrants alike, because most of both are unskilled and uneducated. Even were they legal, they would not be NET payers of taxes, but net users.

    Our immigration system is NOT "broken". What has been "broken" is enforcement of our laws.

    Regarding the comments that there is "no way" to come here: 1 million immigrants manage to come here legally EACH year. They do it primarily because they have family members who sponsor them, the reason that one country, MEXICO, regularly sends 15-20% of our legal immigrants. 800,000 or so immigrants come through FAMILY REUNIFICATION. 140,000 or so come through employment, employment they get because they took the trouble to get the skills and education needed to live here without being a burden on us. Now, just why is it that WE should subsidize millions of poor, unskilled and uneducated workers, legal or illegal?

    Truth, try making your argument to the IRS. You'll find yourself in federal prison pretty quickly. Fact is, if illegal aliens do "pay taxes" (no doubt under a fraudulent or stolen ID) they still receive far more in services than they will ever pay in taxes, even if they were legalized. Consider this: all that money you and your articles claim is "contributed" by illegal aliens, and more, would be ALSO BE CONTRIBUTED BY LEGAL AMERICAN WORKERS.

    Indu, in this country, a law that is passed by the government representing the people of this country is RIGHT until Congress chooses to change the law or the Supreme Court strikes it down.     Indu, we've done "immigration reform", i.e. amnesty in 1986 with a mass amnesty and with several mini-amnesties since. All we've gotten is a failure to enforce the law and much more illegal immigration. We're fed up of a government that lies to us and puts the interest of business and foreigners ahead of those of Americans. We are TIRED AND MAD. Sorry, Indu, but you'd better plan on taking whatever money you've managed to save and returning home for that better life you want, because Americans want a better life for themselves and their kids and illegal aliens make that impossible.

    Britannicus, it really doesn't matter what Janet Napolitano or even Barack Obama want on this issue. We beat back amnesty in 2007 with a Democratic Congress and a Republican president who pressured members of his party into supporting an amnesty bill. And THAT was when the economy was still good. Napolitano and company can keep sending up these trial balloons, but it's Congress that needs to act and it won't because it's members don't want to join the ranks of the unemployed.

    Illegal aliens can get welfare, food stamps, and WIC in two different ways. First, they can use fake or stolen documents, which is what millions of illegal aliens do to get jobs. Second, if an illegal alien has an anchor baby, that baby is a U.S. citizen, and because of that, the mother can legally apply for many benefits including welfare, food stamps, and WIC.

    What we really need is comprehensive border security reform. Build a wall, hire 25,000-50,000 more border patrol agents, and if necessary, supplement our border patrol with military troops.

    We are not anti-immigrant. We are anti-ILLEGAL immigrant. What part of ILLEGAL don't you understand?
    You are right, we don't show compassion to foreigners who have no respect for our country's laws, and who take jobs away from Americans and drive down wages. Why should we have compassion for these lawbreakers? If foreigners want to be "in the system", then they need to come to the United States legally.

    No one of sound mind is fooled by Napolitano's hollow talking points. Her "pathway to legalization" would mean mass amnesty for 12-20 million illegal aliens. We already tried this in 1986 (which failed) and we will NOT be fooled again!

    Furthermore, she has gutted immigration enforcement by rescinding the "no match" social security letters, weakened 287(g), and stopped workplace raids.

    Let's be clear: as she proved in Arizona and is proving now, Janet Napolitano has NO credibility on illegal immigration.

    The answer remains: ENFORCE OUR EXISTING IMMIGRATION LAWS WITH NO FORM OF ANY "PATHWAY" AMNESTY!!

    you say 800.000 come through family reunification. the rest comes through employment. you see, I think it' unfair to deny a chance to immigrate person who doesn't have family ties here.
    did you know that many of those people who come through DV lottery program and family reunification actually leave the country when they realize that they actually have to work hard in order to accomplish something?
    the system IS broken, because if if wasn't people wouldn't be coming here illegally. think about it. people break laws that are not realistic. most people do not kill, because that's the law that make sense. however, most people DO speed, because speed limits are unnaturally low! there was a proposal to adjust speed limits to average speed measured which would let people drive at comfortable speed and avoid tickets. the same thing is immigration. obviously america needs more immigrants. previous amnesties failed because the immigration law itself didn't change! reform is needed!

    The Great Depression President Herbert Hoover ordered the deportation of all illegal aliens in order to make jobs avalible to American citizens.Harry Truman deported more than 2 million illegal aliens.In 1954 President Dwight Eisenhower deported 13 million mexican nationals.
    Explain why it can't be done today?
    Our politicians need to do the right thing for our country and stop the invasion. We are owed that much. Lawbreakers are lawbreakers and whether Mexico wants their undesireables back or not they need to take them back with open arms just like they expect the U. S. A. to do.

    Obviously, "comprehensive immigration reform" a/k/a mass amnesty for 12-20 million illegals, would lead to MUCH more illegal immigration, as the 1986 IRCA amnesty proved.

    The way to reduce illegal immigration is to enforce our existing immigration laws and cut off the jobs for illegals -- to decrease the number of illegals in our country over time.

    This is the cost effective, middle ground, and humane way to deal with illegals in our country.

    And this would have the great benefit of freeing up millions of jobs for unemployed Americans -- including African-Americans who pro-amnesty zealots like Frank Sharry intentionally ignore.

    Do you guys know the legal illegals. Company owners they hire illegals. They do'nt pay a wage at all. they do'nt need a reform cos they dont pay taxes. The legal immigrants do the same they work under table and they do'nt pay taxes they get food stamps and so on. Lawyers take a lot of money from illegals who tried to be legal. Stop this exploitation and legalize the illegals they will be an asset to USA.

    Innocent illegals? That doesn't even make sense. Illegal means in violation of the law. If somebody violates the law, they're not innocent. This country is a land of opportunity for foreigners who come here legally. Illegal aliens have no right to be here and they don't deserve to partake of any of the opportunities that our country offers. No more amnesties for illegal alien lawbreakers!

    Actually, many illegal aliens get all of their federal income taxes refunded by using an ITIN (Individual Taxpayer Identification Number) to file their tax forms with the IRS. An illegal alien can get an ITIN from the IRS with no questions asked. Illegal aliens can get even more money back in a tax refund check than they paid in federal income taxes by claiming the Earned Income Tax Credit.

    Americans do not feel sorry in the least for the illegals, and in fact despise them. They get what they deserve. How are illegals going to pay a fine when a majority of them are using false identification? How are we supposed to know who they are, when they got here, whether they have paid their taxes or not? They have screwed themselves by not abiding by our rulse and laws. And due to that very reason, they deserve nothing but a deportation order. Our gov't is in for a rude awakening when they begin another shamesty attempt. I totally agree with those comments about previous amnesties. They failed miserably and Americans will not allow this to happen again. Please vote out any politician who would stand with illegal law breakers instead of Americans they were chosen to represent. They do not deserve a position of power if they will defend criminal aliens.

    What a bunch of nonsense! Illegal aliens are lawbreakers, pure and simple. Illegal aliens are NOT the backbone of our country's economy. Illegal aliens make up about 5% of our country's workforce. It's the other 95% of our workforce, made up of Americans and legal immigrants, that is the backbone of our economy.

    What do you mean "They donot break any law the law breaks them"? That doesn't even make sense. It sounds like something an ignorant fool would say. Illegal aliens are lawbreakers who have knowingly and willingly violated our country's immigration laws. Every illegal alien who is working in this country has committed a crime, so I agree with you that we should be hunting down these millions of criminal illegal aliens.

    Noooooooo............ Why I thought that the former Governor of Arizona, who fought Arizonans against illegal immigration with a fanaticism rarely seen, was for securing the border and deporting illegal aliens. I shocked I tell you, truly shocked...about as much as I'd be if someone told me it was sunny in the summer in Southern California. She's another Traitor to the citizenry, that's all.
