Will and Kate, Adult Parody Tape?

There is no Will and Kate sex tape. Or is there? A comedian has already said "I don't want to see the birth of the young prince, I want to see how he was conceived!" If there isn't a porn parody tape of Will and Kate, there WILL be. Please note, I'm saying that the tape will be a fake. As this is allegedly a celebrity legal issues column, we will focus on the legality of the tape.

There is a booming market in explicit parody tapes, that became permissible in the US after the Larry Flynt versus Jerry Falwell decision. The US Supreme Court ruled that parody was permissible. The incident was dramatized in the film The People versus Larry Flynt.

A poll indicated that a William and Kate porn tape would top the poll of the tape people want to see. The "teen mom" recently earned several million dollars for making a tape, so the market is there. No one is going to get up at dawn to watch the teen mom's wedding, so the market for a royal parody tape is astronomical. Or would that be Royal Astronomical? The producers are presumably already hiring lookalike royal actors, they are also presumably putting lawyers on retainers.

A quick Google search indicates that there are several "fakes" already out there. A fake tape is different than a parody, because a fake tape is attempting to be real while a real tape is attempting to be fake. Someone who plopped down 49.99$ for a fake tape could potentially sue the maker of a fake tape, but they would have a tough time in court.

Would such a tape be permissible in Britain? Yes and no. The British laws of libel would come into effect, and there are also laws against insulting the monarchy. Please note, I am not insulting the monarchy in anyway. A joke is a joke, but I am well aware of the fate of two of Henry VIII's two wives.

Then again, the Tudors was able to get pretty racy with Henry's sex life, but that's another story.
