What's so great about going to law school in Wisconsin? How about not having to to take the bar exam.
Some, including the dean of the University of Wisconsin-Madison Law School, believe that the Wisconsin diploma privilege should only apply to Wisconsin law school graduates. However, a 2007 law suit on this issue was reopened in July of this year. The defendants: the Wisconsin Supreme Court and the Wisconsin Board of Examiners.
The lawsuit, which focuses on interstate commerce, was originally brought by Christopher Wiesmueller, a 3L in Oklahoma. Yes, it sounds like a classic Con law fact pattern. Can Wisconsin give instate law school graduates the bar exam exemption while they exclude out of state law school graduates from the same benefit?
According to a Marquette Tribune article, Christopher Wiesmueller's intent in the the law suit is not to do away with the bar exam exemption privilege, but to open the benefit up to more students. Perhaps the most interesting thing about this issue is the Wisconson Supreme Court's rationale for having an instate bar exam exemption in the first place. The Court believes that a J.D. from a state school is as good of a measure of competance as passing the bar exam. What do you think?
The suit is set for trial in August 2010.
