Jose Baez is not the villain the media or public has portrayed him to be. Let’s get real. This is the United States of America and in this country, you are presumed innocent until proven guilty. This premise is the very foundation of our country that prevents authorities from taking any person they feel should be removed from the streets and hauled into jail, torture camps or the death chamber without a fair trial. While the Casey Anthony trial was played out on HLN long before it ever came to a courtroom, the very premise of law still exists and applies to Casey Anthony. Casey Anthony was presumed innocent until proven guilty.
Jose Baez is not the villain.
If Casey Anthony was guilty of murdering her sweet, precious 2-year-old daughter Caylee, then it was the state of Florida’s job to prove it. To think that the jury should have just walked into the Orange County courthouse, half-wittedly listen to evidence or the prosecution’s and state’s case, simply because Anthony was presumed guilty through the media, and send her to the death penalty (or as Floridians say “Old Sparky” in reference to the electric chair that has executed some of the state’s most notorious criminals), is absurd.
It was not Jose Baez’ job to present a less-than- strategic defense for Casey Anthony. It was Jeff Ashton’s job to present overwhelming evidence that proved her guilt.
If the evidence wasn’t there or if the prosecution couldn’t find computer searches that would have proved their case, that is their fault.
It was the prosecution’s responsibility to prove Casey Anthony was guilty.
The Innocence Project of Florida shows just how troubling false convictions in the state of Florida truly are. There are numerous people who were railroaded into prison sentences due to faulty evidence, not understanding DNA or laboratory evidence during the time a case went to trial, or offers of immunity that prompted false statements from witnesses.
With modern technology and developed understanding of complex forensic science, more evidence becomes known that reveals an incarcerated person couldn’t have been guilty of a crime.
One of the most staggering aspects of the Casey Anthony case is that Jose Baez revealed in his book “Presumed Guilty: Casey Anthony: The Inside Story” of searches made for foolproof suffocation. The fact that Jose Baez’ team could find these searches and either the prosecution failed to use them or understand their value in their case does not rest on Baez.
The state of Florida was faced with the greatest case in Florida’s history and it was their job to prove Casey Anthony was guilty.
There are numerous people today who still are not 100% certain they believe Casey is guilty or think she had a solid motive for murdering her daughter.
When a young woman is facing the death penalty, you would think the state of Florida would ensure they have enough evidence to get a guilty verdict; or else go for a lesser charge.
What the state of Florida underestimated was Jose Baez.
Jose Baez is in the business of defending those he believes have been falsely accused of crimes to ensure that innocent people are not sent to a life behind bars or even death row.
Casey Anthony’s life was on the line and Baez proved himself despite the odds against him. He fought for Casey Anthony as the innocent woman that she was presumed to be. It was not his job to give a half-hearted defense because Nancy Grace proclaimed Casey guilty to the nation.
The prosecution failed to convince the jury that the evidence proved beyond any doubt that Casey Anthony murdered her daughter in cold blood.
The justice system worked, regardless of how you feel about the outcome.
Casey Anthony went into that courtroom presumed innocent. She had a criminal defense attorney who did everything in his power to prevent Casey Anthony from going to death row, believing in her innocence. Jeff Ashton and Linda Drane-Burdick had the task of proving to the jury that the evidence clearly showed that Casey Anthony was guilty.
If the jury convicted Casey Anthony based upon media coverage and not because the evidence persuaded them, then that may have been the greatest injustice of all.
If justice is to mean anything in the United States of America, the precept that a person is innocent until proven guilty in a court of law, must stand…above all else.
