The Obama Administration may be uncertain how they wish to proceed regarding Prop 8, but on Friday, they urged the Supreme Court to rule the Defense of Marriage Act unconstitutional.
The legal brief filed by the White House should not be a surprise to anyone familiar with the Obama Administration. The White House told the Department of Justice to stop enforcing the Defense of Marriage Act, or DOMA, in 2011.
President Obama and Vice President Biden both expressed support for same-sex marriage in 2012.
Since DOMA was passed in 1996, the national opinion about gay marriage has changed dramatically. Recent polls show majority support for same-sex marriage in America. Don't Ask, Don't Tell has been repealed, allowed gays and lesbians to serve openly in the military.
House Republicans have taken it upon themselves to fund and defend DOMA, to the tune of $3 million worth of taxpayer money. The House Republicans opted to defend DOMA after the Department of Justice refused to defend further DOMA challenges.
The Supreme Court will hear oral arguments on March 27. A ruling is not expected until June.
