What is Initiative for Texas?

There is a movement in Texas that keeps turning up like a bad penny since 1912. NOT because the idea is bad, but because it is an excellent idea. Initiative and Referendum is a legislative process that gives the citizens of a state the power to propose, enact or rescind laws of interest. Texas is one of three western states that deny its citizens this legislative right. The Texas Constitution guarantees this right to its citizens, but the State Legislators do not. “Initiative and Referendum is not about politics, it is about freedom” -- and Texans love their freedom.

An Initiative is a proposal to amend the constitution to enact a law. A Referendum rescinds an amendment or law that is currently enacted. The Initiative and Referendum process can affect tax limitations, legislative terms, paycheck protection and government mandated racial preferences, etc. California is a state, along with Oklahoma, Oregon and Arizona, which seems to utilize this right with some frequency. The most publicized California Initiative involved same sex marriage.

Statewide initiatives are difficult and powerful interests spend tens of millions of dollars to oppose initiatives that will affect their power. The likelihood of failure is more probable than not. However, what the citizen gains in the event of failure, is opening the political door for discussions on the issue of interest. Generally, if a good initiative fails the first time, substantial support will be gained while waiting for the proposition’s reintroduction on a ballot. This will ensure that the ‘monied’ opposition will have a much more difficult time the second time around.

In 1980, when the question was put on the ballot, Texans favored the acquisition of lawmaking power five to one. In 1996, 15 Senators and 58 Representatives (minimums are 21 and 100, respectively) signed the pledge to support the Initiative and Referendum Amendment. So what happened? Even if you have convinced an elected official to sponsor a house bill for an Initiative and Referendum Amendment, a vote of two-thirds majority of both houses are needed in the same legislative year. It seems the problem rests with our State Legislators. Like any government entity, State Legislators are reluctant to release lawmaking power to the citizen. The arguments against giving Texans this legislative power, basically condemns the intelligence and determination of Texas citizenry.

With all Americans being concerned over their loss of freedom and control of their elected officials, it is time for Texans to take a stand and ensure that this lawmaking right is guaranteed to the people of Texas. The Texas Legislature convenes every two years on the odd year and the Initiative for Texas is ramping up for a 2011effort.
