Mark Witaschek is a successful businessman and law abiding citizen living in Washington D.C. On June 7th, 2012, members of the D.C. gun recovery unit asked Witaschek if they could search his home for guns. Witaschek gave them permission. They found one box of Winchester .40 ammunition, a gun cleaning kit (legal), and a Civil War era pistol. They confiscated the pistol even it is legal to own one without a permit.
One month later, on July 7th, 2012, 30 police in full combat gear raided Witaschek's home. His 16 year old son was in the shower and the police broke down the bathroom door with a battering ram and pulled the naked boy from the bathroom and took him to a room with his three siblings.
Witaschek and his girlfriend, Ms Harris were forced to lie face down on the floor, handcuffed, while they could hear the children crying in another room. And what did the search reveal? A 12 gauge shotgun shell, Witaschek kept as a souvenir after it misfired years ago, one handgun holster (legal to own), one spent brass casing for a .270 calibur gun, and one box of Knight bullets for reloading. They were actually for use in antique replica , single shot muzzle loaders.
The search was prompted by a complaint from his former wife that he had threatened her with a gun. The judge found her complaint to be false and threw out her complaint, but the Gestapo....err, I mean the SS....dang, the police raided his home anyway.
Witaschek does own guns, which he keeps at the home of his sister, Sylvia Witaschek, in surburban Arlington, Va. Two weeks after the raid, D.C. investigators along with Arlington police asked for permission to "view" the firearms. Sylvia Witaschek denied their request. The next day the D.C. jackboots....errr, I mean brownshirts....no,no,no, I mean police, accompanied by Virginia police served her with a criminal subpoena.
The raid on Witaschek's house took 2 hours and the police did over $10,000 worth of damage, and just to make sure all of his neighbors knew he was being raided, the vigilantes....errrr. I mean police, shut down the streets for blocks.
Irvin Nathan, Attorney General of the District of Columbia, and total disgrace to his profession signed an affadavit on August 21st , calling for the arrest of Witaschek. His office has refused comment. It should be noted that Nathan is also the weasel that refused to charge Dick Gregory for a crime, when he appeared in public with illegal weaponry.
Mr Witaschek turned himself in at 5:30 AM the next morning. But was not transferred to central booking until 6 hours later, when it would be impossible to be arraigned and assigned bail. Witaschek was not released until the next morning at 10:00 AM. Police Chief Cathy L. Lanier was responsible for that and is also the police chief who refused to arrest Dick Gregory.
In September of 2012, Nathan offered Witaschek a plea bargain if he would plead guilty of unlawful possession of ammunition, for which he would have to serve one year of probation, a fine of $500 dollars and he would have to make a "contribution' to a victim's fund. Witaschek refused.
As a result His Imperial Highness Nathan upped the charges to include illegal ammunition possession from the first search. If the goal is truly to make citizens safer, then Nathan and Police Chief Cathy L. Lanier, should be locked up in a room then have the room thrown away.
