David Goldman was told by a lower court in Brazil that he could pick up his 9-year-old son and bring him back to the United States to New Jersey. David Goldman traveled to Brazil Thursday, but when he arrived was told that a Federal Court overruled the lower court’s decision.
Sean Goldman, the nine-year-old boy went to Rio in 2004 with his mother who illegally took him. The mother, Bruna Bianchi died last year during childbirth. The mother’s family has filed a stay in Rio stating that it won’t be healthy for Sean to be uprooted from his life in Rio, Brazil.
"It is very, very discouraging," David Goldman told CNN's Wolf Blitzer. "I'm very disappointed. This ruling ... has nothing to do with the merits of the case."
It is uncertain if this ruling is permanent order or just temporary, and the court is expected to review it Friday or Monday.
This case has been ongoing for David Goldman who has been fighting to get his son back after Bruna took him there on what was supposed to be a 2-week vacation. She remarried and kept custody of their son. David Goldman is the only surviving parent and believes he should be granted custody. Goldman has been to Brazil numerous times and each time returns disappointed, and this latest ruling isn’t any different.
"I was ready to bring him home and now we have a setback," David Goldman said. "I hope the legal community and Brazilian officials will do the right thing."
Each state has it's own set of child abduction laws according to the State of Utah website. But when one parent removes a child from the United States, state laws no longer apply. It becomes an international case.

I feel for this father --the Brazilian court needs to understand that he is fighting for his right to raise HIS biological child. Sean should be raised by his father, the love this man David has for his child is overwhelming my heart aches for him. As the parent of 3 children I can not even imagine how he must feel.
I do not understand how Brazil can get away with the kidnapping of this American child, it doesnt seem possible in todays day, yet here it is. What is it as Americans can we do to help this father get his child back that was taken away from him so stolen , kidnapped?
That Brazilian stepfather is sick. He is trying to cling to the memory of his late wife by keeping her son and preventing him from reuniting with his real father. Saner minds in Brazil should advise him to move on with his life.
