Brazil custody case; David Goldman wins custody of his son. The Brazilian Supreme Court decided Tuesday that the custody of David Goldman’s 9-year-old son belongs to David Goldman.
David Goldman was told by a lower court in Brazil that he could pick up his 9-year-old son and bring him back to the United States to New Jersey. David Goldman traveled to Brazil last Thursday, but when he arrived was told that a Federal Court overruled the lower court’s decision.
Sean Goldman, the nine-year-old boy went to Rio in 2004 with his mother who illegally took him. The mother, Bruna Bianchi died last year during childbirth. The mother’s family has filed a stay in Rio stating that it won’t be healthy for Sean to be uprooted from his life in Rio, Brazil.
A decision was expected Monday night, but the decision wasn’t released until Tuesday evening. The Brazilian family who has David Goldman’s son attempted to make a last minute deal with Goldman Tuesday, and stated that Goldman could have him if the boy’s maternal grandmother could return with them to New Jersey.
The Brazilian Supreme Court stated that the family now has 48 hours to turn Sean Goldman over to his paternal father. The Associated Press reported that lawyers for both sides have stated there is still a slight chance of an appeal before David Goldman can get Sean on an airplane bound for the US.

Each state has its own set of child abduction laws according to the State of Utah website. But when one parent removes a child from the United States, state laws no longer apply. It becomes an international case.

I have been waiting for this all day...thanks for the coverage. Prayers are answered! But I agree with others....48 hours should not be given UNLESS police are there to make certain they don't abduct this child and take him into hiding. I won't breathe well until they are on American soil!
I've been waiting all day to hear the results. This should have made breaking news on the major news website. I've been praying for this positive outcome for the father. I will continue to pray because I'm apprehensive about the 48 hours waiting period.
It's a shame how the love of money has so much power that it took a situation in which they would lose Bi$$ions to their economy before this case was given the attention it deserves.

I agree with everyone else -- its not over till its over and that means he is back in the good old USA. Those people in Brazil should be treated as criminals and put on trial. I am so thrilled for that man and child. Lets just hope and pray they have not brainwashed him into thinking he should be there and not here -- maybe they already have. This should not have gone on for so long and wouldn't have gotten so out of control if they had done the right thing from the beginning. Why 48 hrs. I agree.. this was an abducted child. Hand the child over now. I wouldn't be surprised if they take off withm the child now.
Salam to David. We might disagree on a few things in life. But this is one subject that I'll stand for you, and even take a bullet for you, just so you'd accomplish it. Your son belongs with you. Subject closed. I send my Dua to the Creator to unite you with your son. Your son needs his father by him in the next 10 years, to grow up and become a real man.
He should never grow up blaming his mothers country for separating him from his father. The Brazilian Government should also be wise enough to look at this aspect, and be ready for the consequences from your son when he grows up, forced by a country to be away from his father.
They need to be back on US soil... Please let this be America's Holiday Present...!

Wow! What an amazing Christmas gift for them both. This definately makes me appreciate every minute I spend with my kids.
I feel Sean's maternal grandmother has some factors in this custody battle. I feel she influence her daughter, Bruna Bianchi into obtaining a divorce from Mr. Goldman and kept the family apart. For this reason, it cause tension among the Goldman and the Bianchi's family. I read a report stating that the maternal grandmother has sent a letter to the current Brazilian president to assist the ruling in their favor. Regardless of what culture or country we are from, it is irrelevant. I understand if the parents can no longer care for their children, it is the responsible of the grandparents. However, in this case, the father is alive and well. He is capable of taking care of his own child. I think the maternal grandmother will go to any length to ruin the relationship among David and Sean. Even if Sean does come and live in the United States with his father, the maternal grandmother will do whatever she can to affect their father and son relationship.
David I know this has been a long and hard road. I encourage you to continue to look towards God... He will renew you, restore your relationship with your son and He will also release you from this back and forth situation. I am praying for you and your sons return to the United States.
