Upstate man charged with engaging a child under 18 for sexual performance

An upstate man is in jail after being charged with engaging a child under 18 for sexual performance, WYFF4 reported January 10.

Michael Anthony Exall, 41, was arrested in Spartanburg County after a woman came forward January 2 stating her 5-year-old daughter had been the victim of sexual assault while spending the night with a friend.

The victim said Exall had taken pictures of her and a child under 11 years old without their clothes on, where the children were forced to perform sex acts on each other.

The assault was reported as taking place between December 26 and January 2.

According to South Carolina Law Title 16-1-60

"producing, directing, or promoting sexual performance by a child (Section 16-3-820); sexual exploitation of a minor first degree (Section 16-15-395); sexual exploitation of a minor second degree (Section 16-15-405); promoting prostitution of a minor (Section 16-15-415); participating in prostitution of a minor (Section 16-15-425); aggravated voyeurism (Section 16-17-470(C))"

Sexual misconduct with a minor is considered a violent crime in South Carolina, punishable with up to 30 years in prison. Since two children were involved, this will likely increase since each child can be considered a separate act and charged accordingly.

Exall is being held at the Spartanburg Detention Center.
