Wayne County Prosecutor Kym Worthy announced Saturday that capital charges have been filed against a man and his mother in the shooting death of Kadejah Davis, 12. The girl was killed by bullets fired through the door of her home in the 19400 block of Ferguson on Tuesday.
Joshua Brown, 19, has been charged with 1st degree murder. His mother Heather Brown, 35, is charged as an accessory after the fact.
Mother Amanda Talton claims she had gone to her tax service to find out why her return was delayed. The Browns blamed the problem on the IRS.
While there Talton found a cell phone in the bathroom and turned it in to an office worker.
She had just returned home when the Browns turned up at her door.
Talton thought they wanted to discuss her tax return, but instead they talked about the cell phone.
Talton was accused of keeping the phone, but she told the visitors her version and closed the door on them, thinking the dispute was over.
But then shots were fired from outside, allegedly by Joshua Brown.
Davis, an honor student, was doing her homework in the living room. Three of the five bullets that passed though the door struck her. She was rushed to a hospital but could not be saved.
Police say Heather Brown drove her son away from the home after the shooting; that is the basis for charging her as an accessory after the fact.
The accessory charge exposes Heather Brown to the same penalty as 1st degree murder. Both defendants, therefore, are faced on conviction with life without parole.
