Even though a few hours after the Aurora Theater shooting, Biological Safety Officer for University of Colorado Denver (UCD) Anschutz Medical Campus (AMC), Therese Stinnett, sent out an email surveying Bio-safety Level Three lab users demanding to know whether they had contact with James Holmes, the American people will not be allowed to see the preliminary hearing on television. BioSafety Level three is the next to last highest level of safety for the containment of bio-weapons and other pathogens. The pathogens at AMC include retroviruses like AIDS, coronaviruses like SARS, and reoviruses which can cause cell death.
One of the primary reasons an event that could impact the health of people worldwide is not on television is that UCD Executive Director of Media Relations Jacque Montgomery claims that James Holmes “did not conduct research while as student at the University. First year students in the program learn research techniques." This statement totally contradicts their own course description of first year students under NRSC 7650 which states “Students perform independent research projects of limited scope during both semesters.” When confronted by the contradictions between the course description and their own statement about Holmes' bona fide research not being covered by CORA, Jacque Montgomery then hid behind the judge's gag order claiming they “cannot answer specific questions about Mr. Holmes” even though she already had when she claimed Holmes did no research. Finally she used the holidays as an excuse to delay a response.
James Holmes used AMC to develop a bio-weapon then he later deployed by aerosolizing it in modified tear gas canisters and creating infection points with a shotgun. The pathogen is blood borne and he tried before the shooting to transmit it sexually.
The prosecution claims that James Holmes did the shooting because his grades were falling. James Holmes' grades were falling because he was working on his bio-weapon instead of his class work. The defense is claiming that James Holmes is mentally ill even though James Holmes planned the bio-weapon before he enrolled at UCD. The plaintiffs claim that the Theater and UCD are responsible because they didn't foresee the attack however even after the event, victims still can't grasp how they were exposed to a bio-weapon.
James Holmes has infected himself and is exhibiting obvious symptoms including dyskinesia. When his brain was checked out after banging his head, the prison officials suddenly wouldn't allow the defense to see him. He is no longer being transported by the jail to courthouse tunnel and is being driven to court from an undisclosed location.
So far there is no indication that his plan was successful in actually transmitting the disease except to himself.
The preliminary hearing is scheduled to start Mon Jan. 7, 2013 at 9 a.m. MST. It should be but won't be televised.
