Considering Tom Cruise’s eagerness to sue the publisher of two tabloids for defamation because they published stories claiming he abandoned his daughter after his divorce from Katie Holmes, people are surprised that the $50 million defamation suit has now been dropped. According to Dec. 24 news reports from International Business Times, Waleg.com and the Journal Gazette, Tom Cruise has dismissed the lawsuit in a California federal court "with prejudice," which means the lawsuit cannot be refilled at a later date.
Fear of What Katie Holmes Might Say
Tom Cruise obviously had ulterior motives for dropping his lawsuit against Bauer Publishing. Many suspect that one of the reasons Tom tried to quietly settle the “Suri abandonment” lawsuit is that Bauer Publishing was planning to have Tom’s ex-wife, Katie Holmes, deposed.
If Katie Holmes were to be legally required to sit for a deposition she’d have to answer under oath questions about whether or not she felt Tom Cruise “abandoned” their daughter, Suri, after their divorce. See Tom Cruise Lawsuit Directs Undue Attention to His 13-Week Absence from Suri
No doubt Bauer’s lawyers would have wanted to get Katie Holmes’s viewpoint on some of the things which came out in Tom Cruise’s own deposition that could prove to be highly damaging to his reputation.
It’s also possible that in a deposition Katie Holmes might be required to reveal embarrassing information about her marriage to Tom and the role Scientology played in their divorce. The “Suri Abandonment” Issue
At the heart of the lawsuit are two cover stories in Bauer Publishing’s tabloids, In Touch and Life & Style, which insinuated that after Tom Cruise’s divorce from Katie Holmes, little Suri had been abandoned by her dad.

It was also revealed in Tom Cruise’s deposition that on more than one occasion Katie Holmes asked him to come to New York to visit his daughter, but he claimed that his filming schedule did not permit him to come. Yet during that same time period Tom flew to London to attend a Scientology conference because he felt it was “an important event.”
It was further revealed in Tom’s deposition that he missed Suri’s first day of school. See Suri’s Religiously Neutral School Should Appeal to Scientologist Dad Tom Cruise. In fact, from June 18 of 2012 until Thanksgiving of 2012, Tom only saw Suri for a total of 10 days.
By dropping his lawsuit against Bauer Publishing, Tom Cruise avoids having Katie Holmes address the matters above. He also avoids having the case go to trial.
