As the President’s approval rating continues to dwindle in Texas, state senators John Cornyn and Kay Bailey Hutchinson have been joined by 36 more senators to fight Obama’s latest attempt to sneak something by most Americans.
The 40 senators announced the filing of an amicus brief that joins the court challenge against Obama’s current stab of the United States Constitution, and efforts to repay his union cronies.
The court challenge and brief came because the senators believe the Obama administration recently violated his powers from the Constitution allowing a president the ability to make appointments when the Senate is in recess.
By January 4, 2012, Republicans had gained bipartisan agreement to keep Congress in pro forma sessions every three days through the holidays in an attempt to keep Obama from filling vacancies.
OBAMA BYPASSED THE SENATE
Obama, who has already been held in contempt for ignoring federal courts before, bypassed the Senate and made the unconstitutional ‘recess’ appointments of individuals to lead the Consumer Financial Protection Bureau (CFPB) and National Labor Relations Board (NLRB).
With no one to hold him accountable but voters, Obama made a pure political move again. Some see this as his attempt to spare Senate Democrats that face re-election to have to file a record of voting pro-union or anti-union.
“Totally political, zero Constitutional justification,” said one observer.
“American democracy was born out of a rejection of the monarchies of Western Europe, anchored by limited government and separation of powers,” Cornyn stated in a release this morning. “We refuse to stand by as this President arrogantly casts aside our Constitution and defies the will of the American people under the election-year guise of defending them.”
February 3, 2012
We the undersigned believe that President Obama’s January 4, 2012 recess appointments of individuals to lead the Consumer Financial Protection Bureau and National Labor Relations Board were unprecedented and unconstitutional. We intend jointly to file an amicus brief challenging the constitutionality of President Obama’s appointments to the National Labor Relations Board and Consumer Financial Protection Bureau.
