Ark. teacher Mary Faith McCormick charged with rape of 13-year-old student

Another school year and another year of teachers behaving poorly. A case in point: Arkansas 6th grade teacher Mary Faith McCormick was charged this week with the rape of a 13-year-old former student, authorities contending that she had sex with the teen at least twice. As Huffington Post reported Aug. 19, McCormick not only engaged in sex with the boy, she also exchanged photos with him depicting herself in various stages of undress.

The investigation of McCormick by the Siloam Springs Police Department began when a 12-year-old girl borrowed the victim's phone and found several semi-nude photos of the teacher. There were also inappropriate messages on the phone. With allegations leveled, investigators began compiling evidence on Aug. 8.

Silaom Springs police confiscated two USB thumb drives, an Apple iPad, two Apple iPhones and a desktop computer. Police also admitted to searching McCormick's Snap Chat account, finding numerous photos and videos of the alleged victim.

It was a Snap Chat photo of the teacher in nothing but a towel that caught the attention of the 12-year-old girl. Borrowing the cell phone, she had accidentally discovered the photo.

An eyewitness stated that they saw a photo of McCormick with wet hair and exposed breasts that was captioned, "I'm not dirty anymore."

Mary Faith McCormick was arrested on Aug. 13. She was released on a $50,000 bond the next day.

According to what the victim told police, the Siloam Springs Intermediate School teacher and the 13-year-old began their relationship in June, shortly following the end of the school year. The two were seeing each other up through August.

The victim told authoritiies that the sex was consensual. However, under Arkansas law, “consensual” sex between an adult and an underage minor is considered rape, according to KFSM in Fort Smith. This follows the legal measure that states that a minor cannot legally consent to having sex.

The relationship began, according to a probable cause affidavit, when the 13-year-old accepted a dare to go over to the teacher's apartment. The alleged victim and another boy visited and watched a movie. The other boy left but the 13-year-old stayed, later having sex in the teacher's bedroom.

The investigation is ongoing.

McCormick's case wasn't the only one in a week when many schools across the country are opening their doors for a new school year. A 39-year-old teacher in St. Petersburg, Fla., was arrested and charged with unlawful sexual activity with certain minors, according to WFLA. And a 28-year-old Oklahoma teacher under investigation in that state for allegedly having an inappropriate relationship with a student was arrested in Mississippi when police there caught her in a hotel room with the same 15-year-old with whom she was accused of having the relationship.
