Supreme Court rejects Arizona plan to ban abortions after 5 months

The US Supreme Court has rejected a ban on most abortions after 20 weeks signed by Arizona Governor Jan Brewer after a federal appeals court ruling that the law “violates a woman’s constitutionally protected right to terminate a pregnancy before a fetus is viable to survive outside the womb.” Viability is generally considered to be 6 months plus.

The earlier judgement made by the 9th Circuit court is binding only within its 9-state territory.

While Arizona isn’t the only state to ban abortions after the 4-month mark, most others, have not been challenged in court, although Georgia’s ban has been enjoined in court on “constitutional grounds,” and opponents to Texas law are mostly challenging the state’s ruling requiring abortion doctors to have admitting privileges at hospitals instead of being able to perform them in private clinics.

Other states with 20-week bans include Alabama, Arkansas, Idaho, Indiana, North Dakota, Nebraska, Louisiana, Kansas, North Carolina, and Oklahoma.
