On Monday morning, the Supreme Court declined a legal challenge to the Affordable Care Act brought forward by former House Majority Leader Dick Armey.
Dick Armey, the former chairman of the Tea Party group FreedomWorks, was joined by other recipients of Social Security in claiming a right to opt out of Obamacare in favor of private insurance plans.
By not hearing the case, the ruling by a federal appeals court stands. The Feb. 2011 appeals court ruling said recipients of Social Security cannot opt out of Medicare benefits, including those provided under Obamacare.
The five plaintiffs in the case included Armey, two other former federal employees, and two wealthy individuals. They maintain private insurance covers more than Medicaid. No law stops individuals from adding private insurance to Medicaid benefits.
The lawsuit was funded by The Fund For Personal Liberty. The group's about page proclaims supporting the Constitution and Bill of Rights against government regulation and involvement.
