We've all heard the old bromide that America has "a government of laws and not of men." John Adams even enshrined that phrase in the Massachusetts Constitution in 1780.
There are reasons why libertarians don't find this concept to be the lofty ideal that so many other Americans do.
For one, it's still "government," and no matter how "government" is defined it is still – everywhere and throughout human history – a criminal mechanism used by sociopathic ruling classes to suck as much productivity out of those being ruled as possible so the rulers can live in the greatest opulence possible.
For another, laws don't grow in fields of lush green clover and cheerful dancing sunlight. Laws are created by men, meaning that "a government of laws is still a government of men."
Every government everywhere, after all, has laws. Kings everywhere had their Royal Decrees. Dictators have their fiat law. Muslims have their Sharia Law. The United States of America had their Chattel Slave Law that made it "legal" for white men to own African people.
"Good governments" created by "good men" may have "good laws" but likewise evil men create evil laws.
There is, in short, nothing particularly meritorious about "The Law."
Which brings us to Sheriff Nick Finch of Liberty County, Florida.
Rather than blindly enforcing "The Law" for no other reason than it was "The Law" Sheriff Finch decided to act as a "Rights Enforcement Officer" rather than a "Law Enforcement Officer" as frequently advocated by Libertarian News Examiner.
For that he was fired.
The story is that one of his deputies stopped a man on a minor traffic infraction, used that as justification to search him and found he had a gun without a permit. So the deputy arrested and jailed him.
Sheriff Finch reviewed the case, gave the man's gun back and sent him on his way.
Now Sheriff Finch has no job, no income, and is facing felony charges from Florida's "government of laws and not of men."
Despite the fact that many libertarians reject the very idea of sheriffs and police forces this man did do the right thing in this case.
Finding themselves on the right side of this injustice are the Save America Foundation, Florida Oath Keepers and The Constitutional Sheriffs and Peace Officers Association, who gathered in Panama City Beach, Florida today for a Sheriff Finch fundraising rally.
