Santa Clara County bans criticism of ObamaCare

According to a report published Friday evening by World Net Daily, Santa Clara County, CA. officials have instituted a ban on making “less than positive” remarks about Obamacare, because they can cause stress for listening co-workers. The county announced the ban after Norina Mooney, a 20-year county employee, was overheard discussing the Affordable Care Act with a co-worker, according to the Pacific Justice Institute, which WND reports is representing Mooney.

According to PJI, the worker who was allegedly "stressed out" over Mooney's criticism of ObamaCare was not even the co-worker with whom she was talking, but a different woman who overheard the conversation. The WND report says this led country officials to determine that discussing ObamaCare "was too political for the workplace."

“It was then communicated to Ms. Mooney that she should step outside if she wanted to say anything controversial or political, such as references to Obamacare that were less than positive,” attorneys for Pacific Justice said. They say the purpose of the ban is “to chill and suppress her First Amendment expression, based on her viewpoint, and to condition her expression on other co-workers’ approval of it.”

The attorneys also said this has caused Mooney “to legitimately fear reprimand and disciplinary action if she comments on a matter of public concern in a way that is deemed by you or a co-worker to be ‘controversial’.”

Santa Clara County officials have not yet responded to questions about the ban.
