San Francisco city attorney doesn't know if Charlie is dead or alive

Rose Bauer has followed Charlie's story for two years with hundreds of thousands of other concerned animal lovers who feel that Charlie's confiscation was unfair and the terms of the settlement, signed under duress to spare Charlie's life, have been obstructed.

Upon the advice of an attorney, Bauer called the office of Margaret Baumgartner, San Francisco city attorney today to try and get clarity about Charlie and the two year saga that has followed this dog and his former owner, David Gizzarelli.

Baumgartner represented the city in the litigation opposing David Gizzarelli in the entirety of the 2 year long ordeal.

Margaret Baumgartner and longtime colleague Rebecca Katz co-wrote the breed specific legislation document 'Man's Best Friend? Breed-Specific and Other Local Regulation of Dangerous Dogs' in 2006 when San Francisco enforced SB861 BSL legislation.

Rebecca Katz since went on to a high paying job as SFACC director, recently fired and escorted from the building. Katz is believed to be the last person to see Charlie alive since being impounded in a dark cell at SFACC for 8 months.

Bauer asked Margaret Baumgarter several questions regarding the obstruction of the terms of the settlement in which Gizzareli was to have input regarding sanctuary for Charlie and was to receive quarterly reports about Charlie's progress.

Bauer's first question to Baumgartner referenced a photograph of Charlie. Gizzarelli has never seen a photograph other than the ones published by the TRD group who've officiated a movement denouncing Gizzarelli and has direct ties to SFACC and Katz before her dismissal in reference to this tirade on the TRD Facebook page involving these members, Katz and a longtime volunteer who's been especially active in Facebook defamation.

When asked about the TRD group meeting with John Mournier, counsel for Gizzarelli, Baumgartner's response to Bauer was that David broke the agreement, too.

Bauer responded about the agreement asking Baumgartner if she was referring to the agreement in which Gizzarelli's dog was literally stolen from him to be held in dark confinement for nearly a year. Bauer added that Baumgartner was aware that David Gizzarelli was on disability, yet still insisted on the charges of several thousand dollars to pay for Charlie's confinement at SFACC.

Baumgartner then told Bauer she would need to go to SFACC and fill out a request asking if Charlie is even alive. Baumgartner added that SFACC probably wouldn't give Bauer the information as she was upset.

Bauer then expressed her feelings and those of others who've voiced concern over Charlie and Rebecca Katz's firing. Bauer noted that since Katz dismissal, people have been coming forward with videos, pictures and testimony that refutes the city's account of incidents surrounding Charlie's seizure and impound.

Pictures of Charlie in a 'sanctuary' with dogs wearing shock collars and basket muzzles has worried those who've been following Charlie's dilemma. One account on the 'sanctuary's' own website depicts a terrible dogfight in which the owner just stepped back and let the dogs have at it. At least one dog reportedly was killed.

For a facility who's own history is to make up stories about rescues to discredit them, this story is especially horrific. The 'sanctuary' was reportedly hand picked by Katz.

Baumgartner's response to Bauer was to the effect this is a private matter and issue.

Bauer is awestruck by this response. "How can this be a private matter? This is a person who is paid by taxpayer's dollars and a city employee. She worked for the public.

Baumgartner's last thoughts on the subject regarded her own job as a city attorney and told Bauer she was unable to do anything.

Advocates are asking for proof of life for Charlie. Please call and ask where Charlie is. Is Charlie alive or is Charlie dead?
