On Sunday, September 8, 2013 Polk County 911 received a call in reference to a structure fire at the Hogue Apartments located at 435 Hogue Avenue in Rockmart.
The Rockmart City Fire Department, Rockmart Police Department, State Fire Marshal’s Office Investigator Jerry Parrish and Detective David Gowens with the Rockmart Police Department responded to the scene.
Rockmart Fire Chief Todd Queen and State Fire Marshal Investigator Jerry Parrish determined that the fire was an act of arson and the case was assigned to Detective Gowens for investigation.
After speaking with the victims and gathering information from the investigation, Detective Gowens obtained warrants on Monday for James Melvin Moody, 62, who lived at the apartments for arson and three counts of criminal attempt to commit murder.
No one was injured in the fire. Two families were displaced due to damage caused by the fire as well as smoke and water damage. American Red Cross officials assisted the families with finding temporary accomodations.
Mr. Moody was incarcerated on the morning of the fire on unrelated charges by Detective Gowens. This investigation is still active and additional criminal charges may be added.
Moody's daughter, Ginger Moody Pinkard stated that her father suffers from is bi-polar manic disorder and she expressed her frustration with the obstacles she faces trying to get mental health care for her father. She states that he has suffered from this mental condition since 1981.
Moody was arrested Sunday and charged with theft by a vehicle, criminal trespass and interference with government property. Moody remains in custody with no bond set on the current charges. See also (9/10/2013) (7/8/2012) (4/1/2012) (10/25/2010).
