“The Real Housewives of Atlanta” star Kim Zolciak went on the reunion show last year to address her short stint on the show, but on that same day, Kandi Burruss had filed legal papers in court against her for using “Don't Be Tardy” without her permission. Of course, the song was done as a favor and Kandi never got any money out of the deal. And one has to wonder if the proper papers were signed to make it a legal agreement between the two. But it all seems to be over now. According to a new Wetpaint Entertainment report published on Oct. 12, “The Real Housewives of Atlanta” star Kim Zolciak has won the lawsuit that Kandi filed against her earlier this year.
Kandi claimed that Kim had “hoarded profits” from the song as she has used it without Burruss' consent. However, the judge didn't see it that way. In fact, it is possible that the judge saw it as Kim did; that the lawsuit was used as a publicity stunt. Kim revealed that she saw the lawsuit “without merit and suspicious in its timing. [...] The song was created by four people who share in the royalties: Kim, her daughter (who co-wrote the original song in season one of the RHOA show before Kandi joined the show in season two) Kandi and Don Vito. To date, Kim has written checks to Kandi and Don Vito in excess of $23,000. In fact, we believe that Kim may have overpaid a portion of their share to date based on the actual record sales. It is clear to us the lawsuit was brought solely for the purpose of publicity because the facts are not in Kandi's favor.”
