The Santa Clara County District Attorney has filed three felony charges for possession of assault weapons against Aldon Smith on Wednesday, according to NBC Bay Area. This stems back from the 2012 house party incident where multiple people were shot and left wounded.
Smith allegedly retrieved a .45 caliber handgun and fired the shot in the air during the house party, according to authorities. He was stabbed twice by a party attendee. Former teammate and current Tennessee Titans TE Delanie Walker was also at the party.
Investigators said none of the weapons he owned were registered with the Department of Justice and investigators said he purchased them in Arizona.
The 49ers released the following statement in regards to the incident:
"We recognize the serious nature of this situation, as does Aldon, and will continue to monitor it closely. As this is an ongoing legal matter, we will have no further comment."
The All-Pro OLB is on indefinite leave after being arrested for driving under the influence on September 20. He has been spending the last two weeks in rehab as head coach Jim Harbaugh said things are going well.
Smith has previously been arrested for a DUI in January 2012. He is already dealing with the civil lawsuits in regards to the 2012 house party incident.
