Aldon Smith was part of a single-car accident this morning in San Jose and has been arrested for the suspicion of driving under the influence and marijuana possession, according to authorities. The third-year linebacker was not injured during the crash. Smith was arrested at 7:02 a.m. and taken to the Santa Clara jail where he was released on bail set at $5,250.
The San Jose Police Department said dispatchers received a call this morning from a resident who reported an accident. When officers arrived, they saw Smith in a pickup truck which ended up being struck a tree. They labeled that he was under the influence and took him to the county jail.
Smith has previously been arrested for a DUI in January 2012 and was stabbed at a party which was at his house in June 2012. He was also a passenger in a car accident last season back in September 2012.
This is the fifth DUI related to the 49ers in three seasons. Ray McDonald had a DUI in 2010 while Demarcus Dobbs and former offensive lineman Al Netter were arrested for DUI last season. In other crime instances, Ahmad Brooks allegedly struck DT Lamar Divens with a bottle, but charges were not filed for assault.
The 49ers released the statement on this incident:
"The 49ers organization is aware of the matter involving Aldon Smith. As we continue to gather information regarding the situation, we will have no further comment."
With this being the second Smith's second arrest, he could be suspended under the NFL's off the field personal conduct policy. Last year, Smith set a single-season franchise record of 19.5 sacks in his second NFL season. Demarcus Dobbs was suspended for the first week of the season for the possession of marijuana.
Smith is also dealing with potential civil and criminal charges in regards to the 2012 house party incident. Jim Harbaugh is scheduled to speak today at 2:15 p.m. as the 49ers practice for Sunday's game against the Colts.
