'Real Housewives of Atlanta' hubby Apollo Nida being sentenced today in Atlanta

Apollo Nida, husband of ‘Real Housewives of Atlanta’ star Phaedra Parks, is staring a long, long prison sentence in the face, and he will know soon just what the courts are going to drop on him--while wife Phaedra vacations with girlfriends in Mexico, according to the Atlanta Daily World. In May, Judge Charles Pannell set Nida’s sentencing hearing for July 8 at 2 p.m.

Nida has already served five years for federal racketeering charges related to auto title fraud. After leaving prison in 2009, he soon married Phaedra. For this current situation, Nida pleaded guilty after his co-conspirator, Gayla St. Julien, received a prison sentence of 61 months. Nida opened a fake debt collection agency, allowing him to access personal information of those in the databases. With these stolen IDs, Nida was able to claim unclaimed funds, refunds, even scheme loans for non-existent cars after creating fake auto dealerships.

For these charges of mail, wire and bank fraud, Nida could find himself in prison for up to 30 years. Lawyers are, no doubt, pleading for mercy from the courts, but with a previous and similar charge, it is not unlikely that their requests will fall on deaf ears. If Nida’s lawyers are successful, however, in changing his status from Criminal History Category V to Category IV, it will make a difference in the maximum time he could be facing.

“A criminal history category of V substantially overstates the seriousness of Mr. Nida’s criminal past, thus warranting a departure from the guidelines range,” his attorneys stated on documents submitted before the holiday, on July 3, Atlanta Daily World (ADW) reported. “Mr. Nida’s lengthy, but early small-time criminal history is simply not in the same league as the ‘violent offenders, drug kingpins and perpetrators of far more serious offenses’ that Criminal History Category V was designed to address.” The history to which the lawyers refer includes incidences of driving under the influence, providing a false name to law enforcement, and having three probation revocations, all before Nida turned 24; he is now 35.

One would assume divorce is impending for Nida and his RHOA wife, but perhaps not, at least according to Nida in the ADW article. “We’re working to make it better,” Nida said. Good luck with that; perhaps when Phaedra returns from her party-time in Mexico, she can shed a bit more light on that situation.
